Board Meeting
The Regular Meeting of the Town Board of the Town of Lexington was called to order on September 20, 2011 at 6:30 P.M., by Supervisor Greg Cross at the Kenneth A. Becker Municipal Building, followed by the Pledge of Allegiance. PRESENT: Minutes Minutes of the September 6th, 2011 regular meeting were accepted on a motion by Councilman Glenn Howard, 2nd by Councilman John Berger and carried. Open Public Hearing Supervisor Greg Cross opened the Public Hearing for the purchase of a garage from Robert Goff, which is located at 11231 Route 23A. Time: 6 37 pm. Garage Purchase Supervisor Greg Cross said that it was discussed at the last town board meeting to purchase the garage at 11231 Route 23A from Robert Goff. For the purpose to current replace the existing highway garage at $140,000. Supervisor Cross suggested using the Good Neighbor Funds for the purchase. Supervisor Cross asked if there were any comments from the public: Resolution # 117-11 WHEREAS, The Town Board of the Town of Lexington has heretofore determined that it is necessary to replace its current Highway Garage, and WHEREAS, a certain real estate with improvements and structures, located at 12311 Route 23A, Lexington, NY has become available to purchase, and WHEREAS, THE Town Board agrees that the purchase of such real is necessary to accomplish the replacement of the Town Highway Garage, and WHEREAS, the purchase price for such real estate is $140,000.00 (One Hundred Forty Thousand Dollars). NOW, THEREFORE IT IS; RESOLVED that the supervisor is hereby authorized to execute any such documents necessary to complete the acquisition of such land for the sum of $140,000.00 (One Hundred Forty Thousand dollars) be expended from the Town of Lexington’s current fund balance, and it is further
Resolution #117-11 – Continued. RESOLVED, that the foregoing Resolution is adopted subject to a permissive referendum, and it is further RESOLVED, that the foregoing resolution shall become effective without action of the Town Board on the 20th day of September, in the year 2011 unless a petition requesting that a Referendum thereon be submitted to voters in the manner required by law. The Supervisor Financial Report was given to the Board Members before the meeting, and on a motion by Councilmember John Berger, seconded by Councilmember Glenn Howard, the financial report of 9/19/2011 was accepted and carried. Points made at the meeting: Should have three separate accounts for the Flood Recovery.
FEMA is paying to put roads back together. Supt. of Highway, Frank Hermance, asked when garbage was going to be picked up again and the sand removed from the main street. It will be discussed tomorrow with Gary Harvey. Items from the flood will be picked up for another month – until October 20, 2011. Thank You Note Council Member Lynn Byrne made a motion, 2nd by Council Member Keith Mellott, to put a “Thank You Note” in the newspaper and was carried, which will be written by Council Member Lynn Byrne. Flood Discussion There was further discussion on flood issues. Greene Co. will sweep Rt. 13A. Council Member Byrne will check into NYS DEC about cleaning out the highway garage -- KEA Engineering is giving free engineering services for flood victims, and the forms are in the Town Clerk’s office. A discussion was held about what should be done with the Highway Garage – oil clean up. Cell Tower Supervisor Greg Cross received a letter from a cell tower company and forwarded it to Councilman Glenn Howard because the town still needs a cell tower and a provider. Grant Moneys Supervisor Greg Cross also said that he received letter in reference to grant funds that the company wants to assist the town. It was from Morris Associates. Public Concerns Councilman Howard said that he noticed that on the Graff’s end of the bridge – a New Jersey barrier has been tipped over and the other is almost ready to slip off the end of the bridge, He was alerting the Highway Supt. so he could contact Greene Co. Highway Dept. (They know about it) Barry Eckstein wanted to know if the September 29th meeting is on or off. Greene Co. will be contacted tomorrow to see about the upcoming meeting. Janice Mellott asked when the Town of Lexington is going to do something with the Schoharie Creek. A discussion was held regarding the Schoharie Creek and what should be done to prevent the flooding. Trees Antonella Casella asked about the trees which are on the line between them and the Municipal Building – they keep falling down on their roof, and the trees need to be trimmed. A discussion was held regarding the trees on the line between the Casella property and the Municipal Building. On a motion by Council Member John Berger, seconded by Council Member Lynn Byrne, the following resolution was This Town Board moves to purchase two (2) sanders for the snow plow trucks, not to exceed the cost of $9,700. because two sanders were lost in the flood of August 28, 2011. Debris Pick Up Last Day to pick up debris will be October 20th, 2011 and it should be out by the roadside for pick up. Schoharie Creek Councilman John Berger said that he would call KEA Engineering, Ewald Schwarzenegger, and try to get him up here to Lexington to inspect the stream – to see what could be done with it and try to set up a plan if he can. Then if a plan comes thru – Supervisor Greg Cross said they would caucus the Town Board to see what could be done. Audit the Bills On a motion by Council Member Lynn Byrne, seconded by Council Member Keith Mellott and carried, the Town Board approved payment of the bills: the following motion was On a motion by Councilmember John Berger, seconded by Councilmember Keith Mellott and carried, that the Town Board moves to suspend the Demolition Permit for three years. Adjourn Council Member Glenn Howard made a motion to adjourn the meeting, seconded by Council Member John Berger. All agreed. Supervisor Greg Cross adjourned the meeting.
