Town Board Meeting 9/04/2007

The Regular Meeting of the Town Board of the Town of Lexington was called to order on September 4, at 7:00 P.M., by Supervisor Dixie Baldrey at the Lexington Municipal Building, followed by the pledge of allegiance. A moment of silence was observed in memory of Jeanette Goff.

Financial Report

Supervisor Baldrey explained the Financial Report to the Town Board Council Members and asked them if they had any questions.

RESOLUTION #91-07

ACCEPT FINANCIAL REPORT

On a motion by Council Member Lynn Byrne, seconded by Council Member Keith Mellott, the following resolution was

This Town Board of the Town of Lexington approves the Financial Report of August 31, 2007, as presented by Supervisor Dixie Baldrey.

Municipal Building Brickwork

Supervisor Dixie Baldrey said that on Wednesday, Sept. 5, 2007, @ 10:00 AM, the bidders for the repair work on the Municipal Building will come and inspect the building for the three phases that they will bid on. And on September 13, 2007, the bids will be opened at twelve noon at the Municipal Building.

Supervisor Baldrey said that there is a problem with the step near the entrance of the Municipal Building at the site of the handicap ramp because there is a large crack in the concrete, and it needs fixing A discussion was held and Councilmember Lynn Byrne will contact William (Bill) Pushman to see if he can fix it.

Health Insurance / Part Time Employees

Supervisor Dixie Baldrey said that she has had two employees ask her if they could join the town’s health plan and pay their own health premium, and therefore it wouldn’t be a cost factor for the town. The Empire Health Insurance plan was contacted and they said that any part time employee would qualify, but you have to earn at least two-thousand dollars a year. The people wanted to know if the Town Board would consider them doing this, providing that they pay there own premium. A discussion was held.

RESOLUTION #92-07

HEALTH INSURANCE / PART TIME EMPLOYEES

On a motion by Council Member Paul Van Valkenburgh, seconded by Council Member Maurice Nelson, the following resolution was

It is resolved that the Town Board of the Town of Lexington agrees to allow part time employees to have health insurance through the town, where they would pay there own premium and meet the health benefit qualifications that are required, such as, having an earnings of at least two-thousand dollars.

Greene Co. Bridge near Schering’s

Emma Jean Fiesinger came in to say that the bridge at the end of Spruceton Valley has deteriorated and wondered if the town could get Greene County to do something about it because the bridge belongs to them. A letter has been sent to Gary Harvey and Mr. Lopez in the past regarding the bridge on Greene County Rt. 6 / Spruceton Road. Councilman Mellott suggested talking to Bill Stein, an engineer for Greene Co. about the bridge.

Reassessment / Property Values

Supervisor Dixie Baldrey said that she would like to set up a meeting to invite the residents of the Town of Lexington for their input for the pro’s and con’s for doing a reassessment for the Town of Lexington in 2009. The Town Board members agreed that this should be done, so they can explain what the assessment would amount to and how it would affect the residents of the town. The Town Board

members decided to discuss the reassessment for the town and hold the meeting on Saturday, September 29, 2007 at 1:00 PM at the West Kill / Lexington Community Improvement Association Building in West Kill, NY, on Spruceton Road. Assessor Georgette Krauss will attend the meeting to give information to the public. (The date has been changed to October 20th at 10:00 AM

Bus Transportation to Catskill

Discussion was held on the Greene County Bus stopping in Lexington for residents who would like to take it to Catskill to shop. Supervisor Dixie Baldrey said that she has to contacted the Greene County Planning Dept. so that they could include it in there budget, and they didn’t seem to have a problem with it, but Supervisor Baldrey said that she would follow up on it again.

Government Day – October 17th, 2007 @ Hanah Country Inn in Margaretville, NY, at 9:00 AM. The Town Clerk has the registration forms if anyone is interested in going. The fee is $5.00 for the workshop, and $10.00 for workshop and lunch.

This Town of Lexington Town Board appoints Ann Marie Phelan as the Zoning Board of Appeals Secretary retroactive back to August 1, 2007, with a term that expires on December 31, 2007 because it is a yearly appointment.

Appoint Sole Assessor

This Town of Lexington Town Board shall re-appoint Georgette Krauss to the position of Sole Assessor for a term of six years, which will end on 9/30/2013.

Board of Assessment Review Member / Needed

Supervisor Baldrey said that the Town Board Members need to replace Jeannine Piccinini as a Member of the Board of Assessment & Review because she is living out of town and is resigning.

Fuel Oil Contract

Supervisor Dixie Baldrey said that she has talked to Colonial Oil Co. and they have agreed to give the town a service contract on the burner, and meet the quoted price for Greene County, so she recommends that the Town should go with Colonial Oil Co. for there fuel needs

The Town of Lexington will purchase there fuel oil and have a service contract with Colonial Oil Company from Tannersville, NY because they have agreed to provide the Town of Lexington with the same quoted price that Greene County will receive for fuel oil, diesel fuel, unleaded premium fuel, heating oil, and a service contract for the oil burner at the Highway Garage and the Municipal Building,.

Hartnett Property

A discussion was held on the Hartnett property.

Moorman Property

A discussion was held on the asbestos at the Moorman property.

Gerulak Property

A discussion was held on the Gerulak property. A meeting was set up by Attorney Tal Rappleyea for September 12th, at 5:00 pm with their attorney. James Boyle has a list of what needs to be done. Supervisor Dixie Baldrey asked what time frame the Town Board would like. A discussion was held.

Councilmember Byrne said that she would like to give a four month time frame to get the survey done, but thought that one year would be plenty of time for the other things.

The time frame was set from September 12, 2007 to September 12, 2008, and they would like to see the work being done in a timely manner during that time frame, and no more than one month to get the survey done.

Main Street

Brush was cleaned up, and Dave Hoyt will cut the trees and drop them, and Greene Co. Soil and Water will do the clean up of the trees after the trees are cut.

Mountain Top Supervisors

Supervisor Baldrey said that the “Inland Waterways” was discussed at the meeting of the Mt. Top Supervisors. They would like the town to pass a resolution supporting the “Inland Waterways”

Supervisor Dixie Baldrey read a letter to the public regarding the “Inclusion of Schoharie Watershed in Inland Waterways.”

This Town Board moves to support the “Inland Waterways”.

Residency

The Town received a proof of residency for Michael Barcone who lives in the Spruceton Valley. The form will be verified that he is a resident and be sent back to the Greene County.

Public Concerns

Stephanie Kizyma asked about getting a new fire number because hers is faded. Councilman Van Valkenburgh told Stephanie that they are being updated now and asked her where she lives.

Marsha Smith asked if the bridge on Spruceton Road is under State or County for repair. Supervisor Baldrey said that a picture had a number on it and that would help them identify who should repair the bridge. Councilman Van Valkenburgh said that all of the bridges in Lexington, with the exception of one, belongs to Greene County.

Jo Ellen Schermerhorn said that she wondered if the town could help her in getting something done on County Route 13 where there is a real safety issue because there is not shoulder and no guide rails where the road goes over a brook. She also said that it has been that way for over a year and the cars come down that hill pretty fast and she has spoken to the Deputy Superintendent for Greene Co. – Mr. Van Valkenburgh, but it didn’t seem to help. Supervisor Baldrey said that she would follow up on that to see if it can get fixed.

Ralph Albino said that he would hope that common sense would prevail and not tie the trouble with asbestos into the building permits for a survey being done for asbestos. Supervisor Dixie Baldrey explained that she didn’t mean that --- a structure that was built prior to a certain year would have to be inspected – is what she meant. A discussion was held on what should be required. Councilwoman Byrne asked the Supervisor to see what the other towns do when she attends the next Mountain Top Supervisors Meeting.

Nancy Kizyma asked if the old post office has been completed with the unsafe building process. Councilman Mellott said that it has been finished – he went on to say that the contractor was paid to put the boards up and demolish the room.

On a motion by Council Member Paul Van Valkenburgh, seconded by Council Member Maurice Nelson, the following resolution was

ADOPTED - Ayes - 5 - Baldrey, Nelson, Van Valkenburgh, Mellott, Byrne.

Resolved, that this Town Board, having audited the following General Fund Vouchers # 181-200, inclusive, hereby, orders them paid and directs the Town Clerk to draw Abstract # 9, General Fund, on the Supervisor for payment of $ 11,416.46.

Resolved, that this Town Board, having audited the following Highway Fund Vouchers #93-104, inclusive, hereby, orders them paid and directs the Town Clerk to draw Abstract # 8, Highway Fund, on the Supervisor for payment of $ 94,325.66.

Resolved, that this Town Board, having audited the following Special Lighting District Fund Voucher # 7, inclusive, hereby, orders it paid and directs the Town Clerk to draw Abstract # 7, Special Lighting District Fund, on the Supervisor for payment of $ 175.80.
