September 1, 2009

The Regular Meeting of the Town Board of the Town of Lexington was called to order on September 1, 2009 at 7:00 P.M., by Supervisor Dixie Baldrey at the Lexington Municipal Building, followed by the pledge of allegiance.

ACCEPT THE MINUTES

                On a motion by Council Member Paul Van Valkenburgh, seconded by Council Member Keith Mellott, the following resolution was

                     Nays – 0
                     Absent – 1- Byrne

This Town Board resolves to accept the minutes of the Regular Meetings held on August 4th, 2009.                             

Financial Report

                Supervisor Dixie Baldrey presented the financial report to the Town Board Members for their review and it was discussed by the Board Members.

RESOLUTION # 103-09
APPROVE FINANCIAL REPORT

                On a motion by Council Member Keith Mellott, seconded by Council Member Maurice Nelson, the following resolution was
ADOPTED - Ayes - 4 - Baldrey, Mellott, Nelson, Van Valkenburgh
                    Nays - 0
                        Absent – 1- Byrne

                It is resolved that this Town of Lexington Town Board approves the Financial Report ending August, 2009.
               
City of NYDEP

                Supervisor Dixie Baldrey reported that she was notified from New York City DEP that they were doing an acquisition for a conservation easement for the property located on New and Grinnell Roads in the Town of Lexington – Parcel Number is 109.00-2-98 which is now owned b by Mountain Top Ministries.   A discussion was held. 

Jaeger Road Extension

                Supervisor Dixie Baldrey and Supt of Highways Larry Cross received a letter from Robert Sainato asking the Town of Lexington to take over the road that extended Jaeger Road by about 700 feet.   The Town Board Members discussed the road and thought that it met all the requirements.  If the Town approves taking over the road, then Robert Sainato needs to draw up a deed to give it to the town and the monuments on the road need to be marked, and so stated in the deed.

Resolution # 104-09 --- Continued

                WHEREAS, Robert Sainato has asked the Town of Lexington to take over the  road that extends Jaeger Road by about 700 feet, and,
                WHEREAS, Robert Sainato has met the requirements according the Highway Regulations, and;
                WHEREAS, the Supt. of Highways, Larry Cross and the Highway Committee have given their approval, therefore;
                This Town Board of the Town of Lexington approves the take over of the 700 feet extension of Jaeger Road, and will advise Robert Sainato to establish the necessary monuments and markers on the road, and have the necessary paper work made up, which would deed the road over to the Town of Lexington.    

                Supervisor Dixie Baldrey will contact Robert Sainato to tell him that the Town Board has approved the take over of the road.

Residency

                The Town of Lexington Town Board verifies that the two following individuals are residence of the Town of Lexington;

                                Robert Megnin, 13 Overlook Drive, Lexington, NY 12452

 Condon Hollow Road

                           Supervisor Baldrey said there was nothing new to report, but Glenn Howard has
spoken to Frank Worner, a resident near where the trail would be, and he had no objection to the trail being near his house.

Veterans Memorial            

                             Council Member Paul Van Valkenburgh reported that they are waiting for the
tree to come down, and the Petosa’s have volunteered to fix up around the monument itself and on the ends, so flowers can be planted.  The Petosa’s will also take out the old flag pole and clean the area up.  Councilman Van Valkenburgh also reported on the prices of new flag poles.  Councilmember Van Valkenburgh will follow up on other prices of flag poles.   The committee would like to put up a new 40 foot flag pole at the center of the lawn where the tree is being removed. Smaller trees will put on either side of the pole and keep the new trees trimmed so they can be decorated with Christmas lights.
 

Tree Cutting

                Council Member Keith Mellott said that Greene County Highway Dept. need Town Highway men to help cut the tree on the front lawn of the Municipal Building and they are on vacation now, so there has been a slight delay on cutting the tree.  Supt. Larry Cross will talk with Dave Hoyt to arrange a time for the cutting of the tree
.   

Speed Limit / County Route 2

                Supervisor Dixie Baldrey read a letter from Teresa Ratel and Carolyn Bennett, who lives at 767 County Route 2 in Lexington, asking to have speed reduction on Greene County Route 2.  The rural back road is designated for 55 mph zone with a suggested speed on many places of 20-25 mph because of rises and dips in the road and a four way feed at the far end of the road, which is about 300 yards from their home. 

 

They went on to say that it is only a matter of time until a walker, jogger, or biker may be struck by one of the vehicles.   A discussion was held. 

RESOLUTION # 106-09
SPEED LIMIT REDUCTION / GREENE CO. ROUTE 2 
          

                On a motion by Council Member Paul Van Valkenburgh, seconded by Council Member Maurice Nelson, the following resolution was
ADOPTED - Ayes - 4 - Baldrey, Mellott, Nelson, Van Valkenburgh
                    Nays – 0
                    Absent – Byrne

                WHEREAS, residents along County Route 2, (Little West Kill area) in Lexington has submitted a letter to the Town Board, and;
                WHEREAS, the traffic passes through with excessive speed on the narrow road which has no shoulders and is very dangerous;
THEREFORE, the Town of Lexington Town Board will contact New York State D.O.T. to have them do a survey to reduce the speed limit and request the following:
Establish a lower speed limit on Greene Co. Route 2, and change it to      30 mph by the State.
Establish the speed limit proceeding west between the intersection of Falke Road and the Lexington town line.
                And forward the request to the Greene County Highway Department.

County Bid / Fuel Oil

                Supervisor Dixie Baldrey said the Town has always participated in the county bids in the past, but the bid came in this year for Main Care, and last year we did the service contract with Kosco for the troubles with the boiler.   A discussion was held on what company to go with since the town has the service contract with Kosco.  Kosco was called to see if they would match the price of Main Care, and they agreed with the price.  So, the decision was to stay with Kosco at the Main Care price.

GCSWCD Watershed Assistance Program

                A letter was received from the Mt. Top Supervisor and Mayor’s saying they would like continued support from Chairman Speenburgh and the County Legislators towards the GCSWCD Watershed Assistance Program of the GCSWCD for the coming year.   Supervisor Baldrey asked the Town Board for their approval in sending the letter of support.

                Councilmember Paul Van Valkenburgh made a motion to send the letter of support for the GCSWCD Watershed Assistance Program, seconded by Councilmember Keith Mellott.
                Aye-4, Nay-0, Absent-1, Carried.   

Ulster Greene ARC

                Received a letter asking for a donation towards their advertising journal which they will distribute in conjunction with their 7th annual “Greene County Recognition Luncheon”   They would like the town to advertise and purchase an ad in their booklet.  A discussion was held.  

                Councilmember Keith Mellott made a motion to purchase a ¼ page at the cost of $50.00, seconded by Councilmember Maurice Nelson.
                Aye-4, Nay-0, Absent-1, Carried.

Mountain Top Friends of Animals

                Supervisor Dixie Baldrey said that the people from the Mountain Top Friends of Animals was at the last Mt. Top Supervisor’s and Mayor’s meeting and asked the town officials to remember them by putting a line item in the town budget to support them on an annual basis.  Supervisor Baldrey said the Town Board will need to consider this at budget time.

Budget Workshop --- Set for Tuesday, September 29, 2009 @ 7:00 PM

Public Concerns

                Stephanie Kizyma asked if the Town could pick up other items beside metal on their next Clean Up Day.  A discussion was held and Supervisor Dixie Baldrey will inquire from other towns how it is done. 

                Greg Cross said that he had no disagreement with the town going with Kosco because they have a service contract with them for their service, but said that there are two oil suppliers in town that might not have bid on the County price.   A discussion was held and  Supervisor Dixie Baldrey said that she would call Hidden Valley and Goff Oil to see what they have to offer.

Correspondence

                A Thank You was received from the Windham Foundation for the donation the town gave them towards their calendar.
                Marie’s Dream House is being auctioned on September 8th, 2009 at 141 Main Street, Catskill, NY in Greene County.
                A Thank You Note was received from the Greene Co. Soil & Water for the donation towards the stream celebration.

PAY THE BILLS

                On a motion by Council Member Keith Mellott, seconded by Council Member Maurice Nelson, the following resolution was
ADOPTED - Ayes - 4 - Baldrey, Mellott, Nelson, Van Valkenburgh
                    Nays – 0
                    Absent – Byrne

                Resolved, that this Town Board, having audited the following General Fund Vouchers # 211 thru # 235, inclusive, hereby, orders them paid and directs the Town Clerk to draw Abstract # 9, General Fund, on the Supervisor for payment of 13,701.57

                Resolved, that this Town Board, having audited the following Highway Fund Vouchers # 104 thru # 116, inclusive, hereby, orders them paid and directs the Town Clerk to draw Abstract # 9, Highway Fund, on the Supervisor for payment of 13,849.71
