Board Meeting

August 4, 2009

The Regular Meeting of the Town Board of the Town of Lexington was called to order on August 4, 2009 at 7:00 P.M., by Supervisor Dixie Baldrey at the Lexington Municipal Building, followed by the pledge of allegiance.

A moment of silence was observed for a town resident, Dorothy Ranfone.  

RESOLUTION # 90-09
ACCEPT THE MINUTES

                On a motion by Council Member Paul Van Valkenburgh, seconded by Council Member Keith Mellott, the following resolution was

This Town Board resolves to accept the minutes of the Regular Meetings held on June 2nd and July 7th, 2009.                         

Financial Report

                Supervisor Dixie Baldrey presented the financial report to the Town Board Members for their review and explained the transfer that was needed.   

RESOLUTION # 91-09
APPROVE FINANCIAL REPORT

                On a motion by Council Member Keith Mellott, seconded by Council Member Maurice Nelson, the following resolution was

                It is resolved that this Town of Lexington Town Board approves the Financial Report ending July, 2009.
               
RESOLUTION # 92-09
TRANSFER / GENERAL FUND

                On a motion by Council Member Paul Van Valkenburgh, seconded by Council Member Keith Mellott, the following resolution was
ADOPTED - Ayes - 4 - Baldrey, Mellott, Nelson, Van Valkenburgh
                    Nays – 0

                This Town Board moves to make the following transfer in the General Fund;
                                                From: Contingency Account (A1990.4) -- $65.00
                                    To:  Municipal Dues (A1920.4) ---------- $65.00

Windham Foundation

                Supervisor Dixie Baldrey said a discussion was held at the last meeting whether to give a donation towards the printing of the community calendar which is being made up by the Windham Foundation.  The Supervisor spoke with Diana Lawrence from the Windham Foundation and the Town Board members agreed to give a donation towards for the printing.

 

RESOLUTION # 93-09
DONATION  FOR PRINTING CALENDAR

                On a motion by Council Member Keith Mellott, seconded by Council Member Paul Van Valkenburgh, the following resolution was

                This Town Board of the Town of Lexington would like to donate $25.00 to the
Windham Foundation towards the printing of the calendar for September, October, November, and December, 2009.

FEMA Close out Check / Falke Road

                The Town received the final FEMA check for $40,242.13 for the 2005 project on Falke Road.  Supervisor Baldrey explained the process and thinks they might still owe the town seven hundred dollars, which will be looked into further.

DONATION  FOR PRINTING CALENDAR

                On a motion by Council Member Keith Mellott, seconded by Council Member Paul Van Valkenburgh, the following resolution was

                It shall be resolved that this Town of Lexington Town Board approves the Expenditures of Highway Money from the Supt. of Highways as stated below.

TOWN OF LEXINGTON, NEW YORK
AGREEEMENT FOR THE EXPENDITURE OF HIGHWAY MONEYS

                Agreement between the Town Superintendent of the Town of Lexington, Greene County, New York, and the undersigned members of the Town Board of Lexington.
                Pursuant to the provisions of Section 284 of the Highway Law, we agree that money levied and collected in the Town for the repair and improvement of highways, and received from the State Aid for the repair and improvement of highways, shall be expended as follows:
GENERAL REPAIRS
The sum of  $60,000. shall be set aside to be expended for primary work and general repairs upon  34.68  miles of Town highways, including sluices, culverts and bridges having a span of less than five feet or the renewals thereof.
PERMANENT IMPROVEMENTS 
The following sums shall be set aside to be expended for the permanent improvement of Town highways.
                a.  On the road commencing at Tumbleweed Ranch Rd. – Starting at Arbor Road and leading to a distance of  3,650  feet, there shall be expended not over the sum of $61,686.88,  Type is  blacktop  , width of travel surface is  20’ , thickness is   2″ Compacted  , sub base is gravel.

Town  Birthday Celebration  
                Supervisor Dixie Baldrey read a letter from Town Historian, Karen Deeter, requesting support from the Town Board in their recommendation for the make up of a committee: Chairperson, Town Historian, one (1) Town Board Member, two (2) Representatives of the Historical Society, and three (3) Members at Large.

SUPPORT THE TOWN BIRTHDAY CELEBRATION

                On a motion by Council Member Paul Van Valkenburgh, seconded by Council Member Keith Mellott, the following resolution was

                This Town Board moves to support the Town Birthday Celebration for 2013 for the Town of Lexington. 

Glenn Howard / Condon Hollow Road

                The paper work has been sent on to Attorney Tal Rappleyea for his information as the town attorney. Supervisor Baldrey said that she thought the next step would be for the Town Board to decide weather they would like to reopen the Condon Hollow Road for recreational use or not.  A discussion was held, and it was suggested that a representative from the town should talk to Frank Worner ---- to give him and his wife the common courtesy to find out what their feelings are in reopening the road for recreational use because the snowmobilers would be going past their home.   Further discussion was held.      

 

RESOLUTION # 96-09
INVESTIGATE CLOSING OF CONDON HOLLOW ROAD

                On a motion by Council Member Keith Mellott, seconded by Council Member Paul Van Valkenburgh, the following resolution was

                    Nays – 0
                       Absent – 1 – Byrne

                This Town Board approves having Town Attorney, Tal Rappleyea, investigate the closing of Condon Hollow Road, and see if it was abandoned properly, and what can be done with it in the future (to see if it can be reopened for recreational use by a snowmobile club).

Veterans Memorial Committee

                Janice Mellott, Glenn Howard, and Council Member Paul Van Valkenburgh are on the Veterans Memorial Committee, They have contacted a monument man, Mr. Henderson, and he will be coming up to check out the refurbishing of the monument that is now in place.  Janice Mellott has spoken to Arnold Jaeger about the new flag pole because he has gotten one on behalf of the American Legion in Prattsville.   
                The committee understands the big tree in the middle of the front lawn would be cut, and they hope to put up a thirty or thirty-five foot flag pole in its place.   They would like to replace the big tree with two smaller trees on each side of the flag pole with flower pots also.  They hope to have it done so it can be dedicated on Veterans Day. 
                Councilmember Keith Mellott said that he would look into getting the big tree cut. 
                Supervisor Dixie Baldrey thanked the committee for making progress on the Veterans Memorial.

Youth Program / Non Residents

                Supervisor Dixie Baldrey and the Town Board Members discussed what they should do next year for the non resident children that attend the day camp for the Town of Lexington because some feel there should be a fee for children from out of town.   Counselors Kenneth and Katie Drao from the Youth Program this year were present to answer questions and made some comments ---- only two children from outside the town attended camp this year.

NON-RESIDENT RATES for YOUTH  PROGRAM

                On a motion by Council Member Paul Van Valkenburgh, seconded by Council Member Keith Mellott, the following resolution was

                    Nays – 0
                       Absent – 1 – Byrne

                The Town of Lexington Town Board shall have a fee for the 2010 Day Camp for children who attend from out of town; and,
                It shall be twenty dollars per child or fifty dollars per family. 

Public Concerns

                Supervisor Dixie Baldrey announced:
                                                The closing of Route 296 for three weeks this summer.
                                                She has flood tips she received responding to the heavy rain.
                                                West Kill / Lexington Community Improvement Association is reopening                                                                             on August 22nd with “Live at the Hall” at 6:00 pm & an open mike.
 Pay for the Youth Counselors

                Kenneth Drao asked if it would be possible for the youth counselors to get their pay checks at the close of camp on Friday because they would be going off to attend college soon.   The Supervisor and the Town Board Member agreed that they did not have a problem with issuing their payment when camp was over. 

Cell Tower

                Antonella Casella said that she live next door and her concern was the cell tower she  heard there was a petition going around to have the cell tower resurrected again, and asked if she could have a copy of the list of names.  Mrs. Casella said that she did not want the cell tower next door to her or in her back yard, and also wanted to know why she didn’t get a courtesy call or letter regarding the tower. 
                Supervisor Baldrey apologized for not notifying Mrs. Casella of the possibility of a cell tower behind the Municipal Building, but the company said that was the best reception. 
                More discussion was held on the pros and cons of the cell tower behind the Municipal Building. 
                Mrs. Casella asked for copies to the list for and against the cell tower and Supervisor Dixie Baldrey said that she would see if it was o.k. under the freedom of information law and would send her what was permissible.
Mike Cotrone said there is health involved with the cell tower, and more discussion was held.  Supervisor Baldrey said the town is trying to find the right place for the cell tower. 
                More discussion was held on the cell tower.

Beech Ridge Road

                Mary Cline asked Supervisor Dixie Baldrey to ask Larry Cross, Supt. of Highways to fill the pot holes on Beech Ridge Road.

Executive Session

Resolved, that this Town Board, having audited the following General Fund Vouchers # 180 through # 210, inclusive, hereby, orders them paid and directs the Town Clerk to draw Abstract # 8, General Fund, on the Supervisor for payment of $ 14,258.82

Resolved, that this Town Board, having audited the following Highway Fund Vouchers # 95 through # 103, inclusive, hereby, orders them paid and directs the Town Clerk to draw Abstract # 8 Highway Fund, on the Supervisor for payment of $ 67,641.72

                Resolved, that this Town Board, having audited the following Special Lighting District Voucher # 7, hereby orders it paid and directs the Town Clerk to draw Abstract # 6, Special Lighting District Fund, on the Supervisor for payment of $ 361.14.
