August 5, 2008

The Regular Meeting of the Town Board of the Town of Lexington was called to order on August 5, 2008, at 7:00 P.M., by Supervisor Dixie Baldrey at the Lexington Municipal Building, followed by the pledge of allegiance.

Accept the Minutes / Regular Meeting

            On a motion by Council Member Paul Van Valkenburgh, seconded by Council Member Lynn Byrne, the following resolution was

            This Town Board resolves to accept the minutes of the regular meeting held on July 1, 2008.

            On a motion by Council Member Keith Mellott, seconded by Council Member Maurice Nelson, the following resolution was

            This Town Board resolves to accept the minutes of the Special Meeting held on July 10, 2008.

RESOLUTION #98-08
Accept The Financial Report

            On a motion by Council Member Keith Mellott, seconded by Council Member Paul Van Valkenburgh, the following resolution was ADOPTED
 Ayes - 5 - Baldrey, Nelson, Van Valkenburgh, Byrne, and Mellott.
 Nays – 0

            This Town Board moves to accept the Financial Report of July 31, 2008, as presented by Supervisor Dixie Baldrey.

Emergency Concerns

Supervisor Dixie Baldrey said that the Town Board members met with the Fire Commissioners on Monday Evening – August 4, 2008, to discuss some possible strategies for the Rescue Squad.
 A letter was received from the Fire Commissioners which asked the Town Board Members to attend a meeting with them to address the status of the Fire Districts Volunteer Rescue Squad because there is a concern because many of the volunteers for the Rescue Squad are away working during the day.  The letter was read to the public for information.
 The Town Board members also received a letter from the Captain of the Rescue Squad, Jack Jordan regarding their concerns and wanted to inform the Town Board that Liza Jordan and he (Jack Jordan) wanted to be on the committee that the Town Board was planning to form so that information can be attained regarding a paid ambulance service.
A discussion was held and a committee was formed to discuss the concerns of the residents of the Town of Lexington regarding the medical needs and care for assistance when there is an emergency within the town.

Rescue Squad Members: Liza Dwon and Jack Jordan
Town Board Members: Lynn Byrne and Paul Van Valkenburgh
Community Residents: Nicholas Palermo and Robert Hermance 

            A meeting will be set up for the committee to explore the issues and what can be done in the time of a medical emergency.   Further discussion was held.

Greene County Bid Prices

RESOLUTION # 99-08
Participate In Greene County Bid Prices

            On a motion by Council Member Paul Van Valkenburgh, seconded by Council Member Keith Mellott, the following resolution was ADOPTED

            Nays – 0

            WHEREAS, Greene County has advertise for bids for supplies, fuel oil, gasoline and etc., and any other materials to be used in highway construction or building maintenance and awarded contracts for the same;
            THEREFORE, BE IT RESOLVED, that the Town of Lexington does hereby want to participate in the purchase of supplies and materials subject to the rules adopted by Greene County pursuant to Section 408-a of the Greene County law. 

Oppose Ban on Burning

RESOLUTION #100-08
Opposition To Prohibit Open Burning

            On a motion by Council Member Paul Van Valkenburgh, seconded by Council Member Keith Mellott, the following resolution was ADOPTED
Ayes - 5 - Baldrey, Nelson, Van Valkenburgh, Byrne, and Mellott.
Nays - 0

This Town Board moves that the Town of Lexington is in support of the Greene County Resolution in opposition of the State Department of Environmental Conservation’s proposal to prohibit open burning across New York State due to the negative impact it will impose on all Greene County residents.

Residency

            The Town of Lexington has received residency verification for Sean De Boyace who lives in the Town of Lexington on Grinnell Road.  The application will be verified and returned to Greene County. 

Storm Water Project Committee / Appointment

            Michelle Yost gave a presentation where the Catskill Watershed Corp. is forming a committee to work with the developers in the watershed area to review the run off of the Storm Water Projects.  Supervisor Dixie Baldrey passed the paper work on to Chairman Glenn Howard to see if the Planning Board had anyone that would be willing to serve on the committee.

Mountain Top Tourism Coordinator

            Supervisor Baldrey introduced Michelle Yost again to explain how the Greene County Watershed Assistance Program and she explained the advantages of having a Tourism Coordinator for the Mountaintop, and how they wanted to come up with the funding.  The Mountaintop Community Resource Strategy has been working for nearly a year now to identify concrete recommendations to help the Mountaintop’s economy and outdoor resource offerings. Creating a tourism coordinator to work with the Mountaintop communities, businesses and not-profit organizations is one resounding recommendation that is within reach, providing there is full support and participation from all Mountaintop communities. The purpose is to lay the groundwork why this position is needed and to ask each municipality to share in the funding of the position in order to strengthen the likelihood the County Legislature and Chambers of Commerce will also contribute.   A discussion was held.      

RESOLUTION #101-08
Mountain Top Tourism Coordinator

            On a motion by Council Member Paul Van Valkenburgh, seconded by Council Member Lynn Byrne, the following resolution was ADOPTED
Ayes - 5 - Baldrey, Nelson, Van Valkenburgh, Byrne, and Mellott.
Nays - 0

               This Town Board resolves that the Town of Lexington would like to go along with the funding for the Mountaintop Tourism Coordinator, and commit the Town of Lexington to their share of funding, which would be for three years – something each year for the three year period, and;
            It further resolves that the Town of Lexington should be kept informed of the situation during that time.

Accountant Contract

Accept Accounting Contract

            On a motion by Council Member Keith Mellott, seconded by Council Member Lynn Byrne, the following resolution was ADOPTED
Ayes - 5 - Baldrey, Nelson, Van Valkenburgh, Byrne, and Mellott.
Nays – 0
     
            It is resolved, that this Town Board of the Town of Lexington will accept the accounting services for the fiscal year ending December 31, 2008 at a fee of $2,800 from Pattison, Koskey, Howe & Bucci, CPAs, P.C., 45 Five Mile Woods Road, Suite #1, Catskill, NY 12414.

Ganem Contracting

            New contracts were signed because at the special meeting held in July of 2008, the completion of the work was accepted as one job; so the change order was for the remaining phases being put all together, instead of individually jobs. 

Batavia kill Stream Celebration will be held on August 9th, 2008 from 10 am to 7pm

Town of Lexington Historical Society will have the town picture on Sat. August 9th, at 9:00 am

Memorial Design – Kevin VanHentenryck is busy now and not prepared to start.

Internet Service – Councilmember Keith Mellott has made phone calls to the internet service trying to set up a meeting.  A meeting will be set up as soon as possible.

Highway Garage – There is information on some of the violations that exist at the highway garage that need to be corrected.   The violations came from the Dept. of Labor and Supervisor Dixie Baldrey said that the Supt. of Highways will be taking care of them.    A discussion was held.

C.W.C. Letter – Supervisor Dixie Baldrey read a letter regarding the “Local Consultation on NYCDEP Land Acquisition Contract”, and asked the Town Board Members to read it so that it can be acted on at the next meeting.

Local Government Days – Wednesday, October 22, and Thursday, October 23, at Belleayre Mountain Ski Center, in Highmount, NY

Public Concerns:

Glenn Howard expressed that he thought the names of the two war veterans that were killed in action from the area should have their names put on the memorial.  A discussion was held.

Glenn Howard asked how the cell tower was coming along.  Supervisor Baldrey said that nothing was happening yet, but a discussion was held.  

Mark Mc Carroll said that he had three concerns: !.) Concern with the traffic on Route 28. 
2.) Traffic gets lost going down Broad Street Hollow Rd. because there is no “Dead End” sign on the road, and  3.) Storey Mountain Road was on his property and said that it might be a civil matter, but would like Supt. of Highways, Larry Cross to come and look at the situation because of the flow of the water down across the town road.  A discussion was held.

Robert Hermance asked what was happening with the Harnett house and read info from the Unsafe Buildings Law.   Supervisor Dixie Baldrey explained what had been done to date and would forward information to him because a public hearing regarding the site has been set for the next meeting of September 2, 2008.  A discussion was held. 

Ray Albino said the grass along the town roads is above the mail boxes and wanted to know when it is going to get cut.  Supervisor Baldrey said that the town mower has been out for repair and the parts came in and they should be out mowing soon.  A discussion was held.

Glenn Howard asked if there was any way to get the Supt. of Highways, Larry Cross, to come to the Town Board meetings to answer concerns about the town roads.  Supervisor Dixie Baldrey said that she cannot make anybody attend a meeting.   A discussion was held.

            On a motion by Council Member Paul Van Valkenburgh, seconded by Council Member Lynn Byrne, the following resolution was
ADOPTED - Ayes - 5 - Baldrey, Nelson, Byrne, Van Valkenburgh, Mellott.
                    Absent - 0                  
                    Nay - 0

            Resolved, that this Town Board, having audited the following General Fund Vouchers #190 through #218, inclusive, hereby, orders them paid and directs the Town Clerk to draw Abstract #8, General Fund, on the Supervisor for payment of $ 13,537.11.

            Resolved, that this Town Board, having audited the following Highway Fund Vouchers #86 through #93, inclusive, hereby, orders them paid and directs the Town Clerk to draw Abstract #7 Highway Fund, on the Supervisor for payment of $14,356.31

            Resolved, that this Town Board, having audited the following Special Lighting District Voucher #8, inclusive, hereby, orders it paid and directs the Town Clerk to draw Abstract #6 Special Lighting District Fund, on the Supervisor for payment of $194.23

            Councilmember Keith Mellott made a motion to adjourn the meeting, seconded by Councilmember, Lynn Byrne.  All agreed.

            Supervisor Dixie Baldrey adjourned the meeting.
