Planning Board Meeting

JULY 10, 2007

Amended

Chairman, Glenn Howard called the regular monthly meeting to order on July 10, 2007 at the Lexington Municipal Building, 3542 Route 42, followed by the pledge of allegiance to the American Flag.

Planning Board Members present were Chairman Glenn Howard, Robert Hermance, Taris Charysyn, Robert Cross, Jr., and Edwin Dippold, Jr.

Absent were Ralph Albino and Susan Constable.

Others present was James Marotta and Rose Williams, Secretary.

MINUTES

Taris Charysyn made a motion to accept the minutes of the regular meeting held on June 12, 2007, seconded by Edwin Dippold, Jr.

Vote: Howard-Aye, Dippold-Aye, Charysyn-aye, Cross-aye. Carried.

Absent were Constable, Hermance, and Albino.

McInnis / Zambito -- Rusk Mt Road – Parcel # 162.00-1-12 & 32

Secretary Rose Williams asked Chairman Glenn Howard if he still wanted a final map with the parcels put together) for the McInnis/Zambito Lot Line Adjustment for the Planning Board because he came in and signed the map that showed the lot line adjustment that was approved the night of the meeting by the Planning Board. There was a question at the June 12, 2007 meeting where a new and final map would be needed, but land surveyor Bruce Maben said that he had to survey it as it was when he was there to survey for the lot line adjustment. Chairman Glenn Howard said that he spoke to Bruce Maben, and said that the map stated that the two parcels were being combined together into one parcel which would show a conservation easement on the upper part. Chairman Howard said that he would like a note made, so that he could follow up on the process, to make sure that things had been completed. Rose will notify the Assessors Office to see if she can get notification of when the parcels have been changed on the tax map and it becomes one parcel.

Marotta Minor Subdivision – 31 Van Etten Road - 10.40 Acres

Subdivide into two parcels – Sketch Plan

James Marotta came to the Planning Board to subdivide his 10.40 acres that is located off Van Etten Road on North Lexington. He said that he came to the Planning Board a couple of months ago in hopes of doing a lot line adjustment because his neighbor wanted the property to join it to his, but that didn’t work out.

Robert Hermance entered the meeting at 7:40 pm

James Marotta said that he has 10.4 +/- acres that he would like to subdivide into two parcels --- Lot #1 being 5 +/- acres and Lot #2 being 5.4 +/- acres. The property is located on the back side of Van Etten Road and a sketch was presented to the Planning Board Members for them to review. The application was also given to the Planning Board members along with a fee of $25.00 for the one new lot. Mr. Marotta was going to have a surveyor come in to survey the property, and the frontage on the new lot would be around 500 feet and the previous one was less than the required 300 feet, but it is existing parcel, so they said that would be alright.

Edwin Dippold, Jr. made a motion to approve the sketch plan presented by James Marotta for subdividing Parcel #109.00-2-55 into two lots, seconded by Robert Cross, Jr.

Vote: Howard-Aye, Dippold-Aye, Charysyn-aye, Cross-aye. Carried

Hermance abstained because he came in late to the meeting.

Absent were Constable and Albino.

Chairman Howard told James Marotta that he should have the contour and elevation lines on the map, along with any wells, and water courses. Chairman Howard said that next month would be for Preliminary Plat Approval and if everything was in order, then he could go for the public hearing and final approval at the following meeting.

Edwin Dippold excused himself from the meeting. Time: 7:52 pm

Dippold Minor Subdivision – Alice Dippold -- Parcel 161.00-1-38

Spruceton Road – Sketch Plan

Minor Subdivision – Property on one side of road

Edwin Dippold, Jr. showed a Minor Subdivision Map of the land of Alice (Marilyn) Dippold where Lot 1 with the house would be 8.294 acres, and the remaining acreage of Lot 2 would be 100 +/- acres. Lot # 1 and Lot #2 would be subdivided by the road (County Route 6). The Planning Board Members reviewed the map, and Edwin

Dippold, Jr. explained that the side of the road with the house had been surveyed, the Thompson line had been done, the Strausser line had been done with a little problem with a foot over the line, which was reflected on the map. Mr. Dippold went on to say that Strausser’s line that was out behind Rappleyea’s had been surveyed and therefore stopped at the pin in the corner, where there is a stone wall that runs up behind Esther Shakun, and a State line that runs along on the back side. Edwin Dippold said that it is not going to be broken up anymore than what the property is now, and that it wouldn’t be subdivided anymore.

Edwin Dippold asked the Planning Board members if there was anything more that they would like to see on the map beside the contour lines. Robert Hermance asked if there were any easements on the property now, like electric, water rights or …… A discussion was held. The Planning Board Members discussed the final map and decided that it should have contour lines, show the pad, and an existing driveway.

Chairman Howard said there would be a $100.00 application fee plus the fee of $25.00 for each lot for a total due of $150.00, which was paid by Alice Dippold.

Robert Hermance made a motion to give Sketch Plan Approval on the Dippold Minor Subdivision, where Parcel # 161.00-1-38 would be subdivided into Lot # 1 of 8.294 acres with a house, and Lot # 2 of 100 +/- acres, seconded by Robert Cross, Jr.

Vote: Howard-Aye, Dippold-Abstain (Involved), Charysyn-aye, Cross-aye, Hermance- aye. Carried. Absent were Constable and Albino.

Mason Minor Subdivision (For the record)

Rose Williams, as Tax Collector, gave George Mason copies of his tax bills and Mr. Mason didn’t think that the tax bills reflected what he thought the acreage should be on the two parcels, so he went to Greene County Clerk and checked it out further, and apparently the lot line adjustment of 2.825 acres from Parcel 1-49 that was added to 1-50 that was done in September 2005 was never recorded with the Greene County Clerk. So therefore, Mr. Mason asked Surveyor Bruce Maben to make another set of maps up for him and Chairman Howard came in to sign and update the maps with a new date on them for filing with the County, which were filed with Greene County Clerk by George Mason.

Taris Charysyn made a motion to adjourn the meeting, seconded by Robert Hermance. All agreed.

Chairman Howard adjourned the meeting.
