Board Meeting 7/03/2007
The Regular Meeting of the Town Board of the Town of Lexington was called to order on July 3, 2007 at 7:00 P.M., by Supervisor Dixie Baldrey at the Lexington Municipal Building, followed by the pledge of allegiance. A moment of silence was observed in memory of George Dymond and Marion Meguin

ACCEPT THE MINUTES OF 6/5/07

This Town Board moves to accept the minutes of June 5, 2007.
Transfer
A discussion was held that a transfer might be needed in Street Lighting (A5182.4) next month.
Financial Report
The Financial Report of June 2007 was presented by Supervisor Dixie Baldrey and the Town Board Members discussed the report.
RESOLUTION #75-07
ACCEPT THE FINANCIAL REPORT

This Town Board resolves to accept the Financial Report of June 2007 as presented by the Supervisor.
Fuel Oil Bids
Supervisor Dixie Baldrey said that she had a conversation with Matt Leach regarding the status of Colonial Oil Co. making deliveries for our fuel oil needs. They said that they would meet the County bid on the gasoline and diesel at the Highway Garage; and the fuel oil for Garage and the Municipal Building.
Supervisor Baldrey said that she also asked about a service contract and he wasn’t sure about that, and was hesitant because of the old commercial burner that is in the basement. But the paperwork that was received last year showed that Kosco, Batavia Kill, and Main Care ----- all offered a service plan to the town.
Supervisor Dixie Baldrey said that she would discuss it further with Matt Leach at Colonial to see what can be worked out regarding the gas and fuel because she and the Town Board said they would like to go with Colonial if they can get it at the same cost as the County price. Supervisor Baldrey also said that she would like to settle the fuel issue at the August meeting.
Web Site
Council Member Lynn Byrne has looked into the possibility of having a “Town of Lexington Web Site”, and contacted Peter Peters to see if he would be interested in doing the web site for the town. He was interested and his basic fee for a 4 page site was $475.00 and an 8 page site would be $650.00 with any additional pages at $100.00 per page. He also said that he could host the site, with a monthly charge starting at 9.95 per month, but it does depend on the size of the site and the traffic to the site. A discussion was held on doing the web site.

ESTABLISH A WEB SITE FOR TOWN OF LEXINGTON
On a motion by Council Member Paul Van Valkenburgh, seconded by Council Member Maurice Nelson, the following resolution was

This Town Board agrees to contact Peter Peters to institute and set up a Web Site for the Town of Lexington.
Councilmember Lynn Byrne will get in touch with Mr. Peters to see when he can meet with town officials to get started on the web site.
Grant from CWC (Amended Part)
Supervisor Dixie Baldrey said that the CWC grant could be completed and applied for, but she was never sure what could be obtained, so she asked for suggestions at he Mountain Top Supervisor’s meeting and they said that it could be used for helping along County Rt. 13A as far as the development and planning along the creek – to control the tepidity, and etc. Supervisor Baldrey said that the grant is due August 1st and asked Councilmember Byrne to look into the grant. Further discussion was held.
Code Enforcement Report
Code Enforcement Officer, James Boyle said that he received a call from Thomas Murphy saying that he contacted someone to clean up the side walk debris and remove the wall and build a fence to protect the pedestrians, but is waiting for funds to finish the job. A discussion was held.
No further movement on Gerulak property on County Rt. 13A.
The town his a snag with the Roger Hartnett Lease Agreement – He took his agreement to his attorney to have it notarized when his attorney advised him not to sign because the town should assume the responsibility for the taxes on the property. A discussion was held.
A discussion was held on the Gerulak property, and if they were ever served their papers regarding the unsafe structure. Supervisor Dixie Baldrey said that she would contact Attorney Tal Rappleyea, to see what the status was on the property.
Brick Repair at Municipal Building
Doug Van Duesen from Lamont Engineers sent a project work description for the entire project and explained how he thought the project for the repair should be set up. For an example, Doug thought that the front should be done in Phase I because it is the worst part, and then follow up with the other sides as Phase II, and Phase III ---- do a section at a time, and if one breaks it down that way --- it might be cheaper.
A discussion was held and the Town Board Members decided to have a special meeting on Monday, July 16th, 2007 at 3:30 PM. It will be advertised in the local newspaper.
Correspondence
Local Government Days will be held on October 17, 2007 --- We are waiting for the applications to sign up.
Supervisor Dixie Baldrey said that she was happy to report and to congratulate a Town of Lexington resident from West Kill – Haila Van Hentenryck, as the valedictorian for the 2007 graduating class from Hunter-Tannersville Central School.
Cell Tower
Supervisor Dixie Baldrey explained that the company of JNS Enterprise had come to the Town of Lexington and went to different locations that are owned by the town to see if any of them had the potential for a cell tower, and added that the company would only deal with Municipalities. The cell tower company reported that there were parcels that were feasible, which was the Sand and Salt Shed and the Municipal Buildings; but the Municipal Building was the best.
Joseph Romanec said that he had information to give to the Town Board members regarding the use of cell towers because he was not in favor of the town putting up a cell tower. Mr. Romanec also had a petition that he canvassed the community with that stated: “The following full time and part time residents oppose the construction of a cell tower in the Town of Lexington due to the various health hazards that can be caused by this installation and the depreciation of their property value:” The total number of signatures on the petition was 85.
Joseph Romanec said that he discovered that the Federal Communication Commission, which is suppose to monitory cell tower omission, doesn’t do that, and they don’t seem to be concerned about it. Mr. Romanec compared the omission from cell towers with other countries to ours. He said that property values would decrease with a cell tower. The literature that was presented to the Town Board Members is on file with the Town Clerk for anyone wishing to review it.
Irene Barnum gave her points of view and she thought that is was a dangerous health hazard for people in the area.
Supervisor Dixie Baldrey said that this was not going to get done right away and would require research for months to come, but had heard from many residents over the years that expressed an interest by saying that they would like to see modernized cell phone and computer services in the community, but one needs to accomplish it with out marring the beauty of the area. Supervisor Baldrey went on to say that it was a time for investigating the cell tower issue and to hear the concerns of the people in the town. More discussion was held on the cell tower issue.
Greene County Youth Fair Donation
Supervisor Dixie Baldrey said that she received a letter asking for a donation towards the fair where they will have the battle of the bands, a car show, and a fireworks display. The donation would go towards the fireworks display. A discussion was held.

On a motion by Council Member Paul Van Valkenburgh, seconded by Council Member Lynn Byrne, the following resolution was

Whereas, this Town Board resolves that Greene County Youth has solicited the Town of Lexington for funds towards their fair and fireworks display;
It further resolves to expend the sum of ($100.) one-hundred dollars to help defray the expenses of the fireworks for the youth and children of Greene County.

Resolved that this Town Board, having audited the following vouchers, inclusive, hereby, orders them paid and directs the Town Clerk to draw up the Abstracts on the Supervisor for payment of the following amounts:

General Fund No. 137 through 154 = $2,089.67
Resolved that the bills be paid on Abstract #6 in the following amounts:

With no further business, a motion was made by Councilmember Keith Mellott, seconded by Councilmember Paul Van Valkenburgh, that the meeting should be adjourned. Carried unanimously.
Supervisor Dixie Baldrey adjourned the meeting.
