Board Meeting

Town of Lexington Planning Board
JUNE 8th, 2010

Chairman Robert Hermance called the regular monthly meeting to order on June 8, 2010 at the Lexington Municipal Building, 3542 Route 42, followed by the pledge of allegiance to the American Flag.  

Planning Board Members present were Chairman Robert Hermance, Susan Constable, Taris Charysyn, and Edwin Dippold, Jr., Ralph Albino, Carl Davis, and William Pushman.  

Others present were Rick & Patti Brooks, Marilyn Hoppenfeld, Katie Drao, Mike Runyan, Frank Mauro, Alexandra Cavaliere, and Rose Williams, Secretary.  (Katie, Mike, Frank & Alexandra were students from a school government class and Rick Brooks explained the subdivision process to them.)

Correspondence:  Received a letter from the NYS DEC, Division of Water, regarding the flood map
modernization program for the NYC Dept. of Environmental Protection.  It said that they were sorry that the town missed the opportunity to meet to discuss the program to update the Flood Insurance Rate Maps (FIRMs). 

            Received notification from the Greene County Clerk that maps were filed for the subdivision of Agnes Smith property and the Piccinini & Graham property.   
 
Minutes

            Taris Charysyn made a motion to accept the minutes of the Planning Board Meeting held on May 11, 2010, seconded by Edwin Dippold, Jr.

Stewart Wexelbaum / Lynn Loflin Minor Subdivision  -- Preliminary Plat Approval

            Rick & Patti Brooks from Brooks & Brooks Land Surveyors, P.C. were representing Wexelbaum and Loflin at the meeting.   Rick Brooks said that he put the contour lines and the right-of-way to the Graff property on the map for Preliminary Plat Approval.   The maps were reviewed by the Planning Board Members.   Lot #1 of 37.59 acres is vacant land which would be sold to NYC DEP after the subdivision is finalized, and Lot #2 would be 13.01 acres with the house and buildings, and would be retained by Wexelbaum & Loflin

            Chairman Hermance asked the Planning Board Members if they had any questions on the Preliminary Map.   Chairman Hermance asked about access off the road to the public and they said that it would be everywhere along Spruceton Road.   Mr. Brooks also said that there was an existing fishing easement that NYS DEC has along the West Kill Stream. 
           
Marilyn Hoppenfeld asked about the access because she is an adjoining land owner, and she was concerned because the map did not show (Deyoe) her road.  She did not want anyone to have access to her road, and Chairman Hermance said they would not be touching her property at all.   Marilyn Hoppenfeld said that she didn’t want the road on her property accessed.  A discussion was held.

Marilyn Hoppenfeld asked if the area was going to be maintained so no one could build dams once the city owns it.  Rick Brooks assured her that NYC DEP watches their property pretty aggressively.   She was concerned with another property having a dam, which makes her trees die. 

            Taris Charysyn made a motion to accept and approve Preliminary Plat Approval of the Minor Subdivision of the Stewart Wexelbaum / Lynn Loflin Minor Subdivision, where Parcel # 160.00-2-31 of 50.60 acres would become Lot #1 of 37.59 acres and Lot #2 of 13.01 acres, seconded by William Pushman.

Close Regular Meeting / Open Public Hearing 

            Susan Constable made a motion to close the regular meeting and go to the public hearing that was scheduled for 6:45 pm for the Wexelbaum & Loflin Minor Subdivision, seconded by Ralph Albino.

Wexelbaum & Loflin  Minor Subdivision --- Public Hearing -- 7:52 PM

Chairman Robert Hermance opened the Public Hearing for the Wexelbaum & Loflin Minor Subdivision and asked the public if they had any questions or comments regarding the minor subdivision.

Marilyn Hoppenfeld said that she would state her comment again for the record by saying; “She had no problem with it as long as the City is going to watch all of the land that they are getting, and have no further damming of the water, and she was sure that NYC DEP was well aware of her concerns with the damming and stopping the natural flow of water.” 

Surveyor Rick Brooks said that he could not guarantee anything, but from past experience, NY City loves their water and will do whatever it takes to protect it.

Chairman Hermance said that he did not believe they could put a dam in anywhere without a permit to do so.

Marilyn Hoppenfeld wanted to be assured that according to the plans; there would not be any access to and from her (Hoppenfeld) property.

Chairman Robert Hermance asked for any more comments and there were none, so Chairman Hermance called for a motion to close the Public Hearing.  
           
Close Public Hearing & Reopen Regular Meeting

            Planning Board Member William Pushman made a motion to close the Public Hearing for the Wexelbaum & Loflin Minor Subdivision, seconded by Susan Constable.  Time: 6:59 pm

Vote: Hermance-aye, Constable-aye, Dippold-aye, Albino-aye, Pushman-aye, Davis-aye, &
         Charysyn-aye.  Carried

         Chairman Hermance reopened the regular meeting of the Town of Lexington Planning Board and asked for a motion to accept Final Plat Approval for the Wexelbaum & Loflin Minor Subdivision. 

 

Final Approval – Minor Subdivision for Stewart Wexelbaum & Lynn Loflin
                             Parcel #160.00-2-31 == 50.60 Acres -- Spruceton Road
                                         Lot # 1 = 37.59 +/- Acres
                                      Lot #2 = 13.01 Acres

            Susan Constable made a motion to give Final Approval for the Minor Subdivision of Stewart Wexelbaum and Lynn Loflin where Lot # 1 would be 37.59 acres and Lot # 2 would be 13.01 acres,  seconded by Taris Charysyn.

The Wexelbaum and Loflin Minor Subdivision file consisted of the following:

A completed application and a paid filing fee of $100.
Paid fees for certified letters and notice in newspaper - $44.48
Sketch Map of subdivision
Completed Short EAF
Publication for Public Hearing placed in Windham Journal
Minutes for 5/11/10 – 6/8/10
Certified return receipts & letters sent to adjoining land owners
Final Map of Subdivision signed by the Chairman on 6/8/2010.

              Chairman Robert Hermance signed the maps and mylar for the Wexelbaum and Loflin Minor Subdivision and Brooks and Brooks Land Surveyors, P.C. will file the maps with the Greene County Clerk.

           Ralph Albino made a motion to adjourn the meeting, second by William Pushman.
Everyone agreed. 

           Chairman Robert Hermance adjourned the meeting.
