June 3, 2008

The Regular Meeting of the Town Board of the Town of Lexington was called to order on June 3, 2008 at 7:00 P.M., by Supervisor Dixie Baldrey at the Lexington Municipal Building, followed by the pledge of allegiance.

A moment of silence was observed in memory of Elsie Konzevich & Daisy Van Etten

RESOLUTION # 76-08

ACCEPT  THE  MINUTES / Regular Meeting

 

            On a motion by Council Member Paul Van Valkenburgh, seconded by Council Member Maurice Nelson, the following resolution was

ADOPTED - Ayes 5 - Baldrey, Byrne, Nelson, Van Valkenburgh, and Mellott

                    Nays - 0

 

            This Town Board resolves to accept the minutes of the regular meeting held on May 6, 2008.

 

RESOLUTION # 77-08

ACCEPT THE  FINANCIAL REPORT

 

            On a motion by Council Member Lynn Byrne, seconded by Council Member Keith Mellott, the following resolution was ADOPTED

 Ayes - 5 - Baldrey, Byrne, Nelson, Van Valkenburgh, and Mellott.

 Nays – 0

 

            This Town Board moves to accept the Financial Report of May 31, 2008, as presented by Supervisor Dixie Baldrey.

 

Ambulance Service

 

            Glenn Howard and Jack Jordan gave reports saying that a lot of research has not been done yet, but gave a couple of scenarios that the town could consider.  Glenn Howard said that Lexington could maybe combine with Jewett and Ashland and have one central location for the ambulance, which would give you a greater pool of people and they would have  someone on call at all times.   Another option would be to hire people to a cover for the off hours and be on call at home, pay a fee for an eight hour shift – like $25.00, and if one did go on a call – then they would be paid additional money --- the town would take that over.    Further discussion was held on the future ambulance service for the Town of Lexington.

 

Youth Program

 

            Youth Director, Nina Berger, is starting the Youth Program on July 8th and running through August 7th, and will be held on Tuesdays and Thursdays.  Registration & Consent Forms are available at the Town Clerk’s Office during office hours.   The Zoom Flume date has been set for August 6th, with a rain date of August 8th.  The contact phone number for Youth Director, Nina Berger is 989-6373.   The program will be advertised in the Windham Journal, Posters in each Post Office, and can be put on the  Web Site. 

Sprouts Program

 

            The donation to the Sprouts Program was tabled last month because the Town Board Members wanted to find out who from Lexington was participating in the program.  Council Member Lynn Byrne reported that she tried to find out and they said that registration was not over until next Friday (June 13, 2008), so it was tabled until next meeting.

 

Used Items in Records Room

 

Supervisor Dixie Baldrey said there are many used and broken articles of no value on the shelf in the records room, and asked the Town Board Member if they would  pass a resolution to dispose of the useless items. 

 

RESOLUTION #78-08

DISPOSE OF BROKEN AND USELESS ARTICLES

 

            On a motion by Council Member Keith Mellott, seconded by Council Member Paul Van Valkenburgh, the following resolution was ADOPTED

 Ayes - 5 - Baldrey, Byrne, Nelson, Van Valkenburgh, and Mellott.

 Nays – 0

 

            WHEREAS, The Town of Lexington has articles that are broken and;

            WHEREAS, those articles have no value or use to the Town of Lexington; therefore;

            This Town Board moves to dispose of the following articles and remove them from the Inventory List of the Town of Lexington:

Falke Road

 

            Ken Aurigema, Director of the Catskill Christian Assembly said that he would like to request a meeting with Dewkett Engineering Firm – the engineering firm contracted for the repair of Falke Road.    Mr. Aurigema said that he has tried to contact them many times for this meeting and no response has been made, and the project is supposed to start on or around June 15th.  Mr. Aurigema said that his Board President will be in town on Friday (June 6th), so the engineering firm will be contacted to see if they can set up a meeting.  Further discussion was held on the Falke Road repair.

 

Crump Road Litigation

 

            Supervisor Dixie Baldrey explained the law suit to the public, where the two towns (Lexington and Shandaken) were asked to relinquish this section of road.  The paper work has been submitted for the legal matter, and it is in the hands of the Town of Lexington Attorney, Tal Rappleyea.  A discussion was held.

 

Municipal Building Brick Work – Doug Van Duesen

 

            Engineer Doug Van Duesen reported that the brick work is 60% complete and the application for payment will be $25,650. payable to Ganem Contracting Corp. (Total amount was $64,000.)   Engineer Van Duesen said that the replacement bricks were matched well; pressuring washing was done where it was needed, and it will be sealed when it is completed.   A discussion was held further on the progress of the brick work. 

 

RESOLUTION #79-08

GANEM CONTRACTING PAYMENT

 

            On a motion by Council Member Keith Mellott, seconded by Council Member Maurice Nelson, the following resolution was ADOPTED

 Ayes - 5 - Baldrey, Byrne, Nelson, Van Valkenburgh, and Mellott.

 Nays – 0

 

            This Town of Lexington Town Board moves to make a payment of $25,650. to Ganem Contracting for the brick work on the Municipal Building.

 

Roof Repair

 

            Supervisor Dixie Baldrey said the WeatherGuard Roofing Co. from 2880 Curry Road, Schenectady, NY 12303 gave an estimate of $1,500. for the repair to the roof, and the Town Board decided to go with them.  They will be coming soon to do the repair in one day.  A discussion was held on the repair;  weather it would be a minor repair or what happens if it is major repair. 

 

Health Club Plaque

 

            The Town Board Members decided that the Health Club Plaque will be put on the wall near the main entrance area of the Town Clerk’s Office.

 

Batavia Kill Stream Celebration 

 

            Supervisor Dixie Baldrey said the Town of Lexington has been invited to the Batavia Kill Stream Celebration that is scheduled for August 9, 2008.   They said that the cost for the specific event is significant and asked the town for a sponsorship on behalf of our municipality.  Supervisor Dixie Baldrey said that she wanted to wait until the Mountain Top Supervisor’s meeting being held on June 4th, to see what the other towns are proposing in their towns.   Everyone agreed.

 

Tim Cox / Spread Gravel

 

            Council Member Keith Mellott talked to Tim Cox from NYS DEC, and the Greene Co. Soil and Water is going to spread the gravel along Spruceton Road.

 

Zoning Board Member Needed

 

            Supervisor Dixie Baldrey asked Richard Timmerman if he would serve as a member on the Zoning Board of Appeals.   Richard Timmerman said that he would serve as a member of the Zoning Board of Appeals.   

 

RESOLUTION #80-08

APPOINT ZONING BOARD OF APPEALS MEMBER

 

            On a motion by Council Member Maurice Nelson, seconded by Council Member Paul Van Valkenburgh, the following resolution was

ADOPTED - Ayes - 5 - Baldrey, Nelson, Byrne, Van Valkenburgh, Mellott.

                    Nay – 0

 

            This Town Board resolves to appoint Richard Timmerman as a member of the Zoning Board of Appeals with a term that will expire on 12/31/2010, and this term will fill the unexpired term of Margaret Lawrence because of her resignation.

 

Concrete Front Step

 

            Supervisor Baldrey reported that a notice was received from the Greene Co. Board of Elections and they are interested in safe and adequate entrances for the polling sites because it is the means for the people to get to the polling site to vote.  They further stated that if there was a problem with the site, they would consider fixing it. Therefore, Supervisor Baldrey said that the front step should be considered because it has two huge cracks, which makes the step unsafe.  A discussion was held on the repair of the step ----- Greene Co. Board of Elections will call the Supervisor back to discuss the repair further.

Town Wide Yard Sale

 

            A discussion was held about the town wide yard sale and how it is usually done in other towns.   Prattsville will be contacted to see how they do the Town Wide Yard Sale. 

 

Deer Pen Estates Road

 

            Sal Mancuso said that he would like to have a meeting with the Town of Lexington Highway Committee to review the Deer Pen Estate Road.  A discussion was held on what has been done to date on the road and what needs to be done yet.  Chairman of the Highway Committee, Council Member Paul Van Valkenburgh, will set up the meeting with Sal Mancuso and the Town of Lexington Highway Committee.

 

Memorial Drawings

 

            Supervisor Dixie Baldrey said that she received two drawings for the Veterans Memorial, when an advertisement for drawings was published in the Windham Journal.   The two drawings submitted were from Janice Mellott and Kevin Van Hentenryck.   Supervisor Baldrey said that the idea was to have something generic, so that it would speak to all veterans as a whole.   A discussion was held on the memorial and how it should be done.   Supervisor Dixie Baldrey said the Town Board Members will get together and make up the wording that should be displayed on the monument, and try to get this thing done.   Council Member Lynn Byrne will see if people are available for in kind services.

 

Wild Blue Internet Service

 

            Council Member Keith Mellott reported that they would come when the town says they would like them to come, and he went on to say that the internet provider thought that the initial installation would cost around $1,100.   Council Member Mellott also said that there would be modem(s) at a central location for the hook ups.  Hughs.net was also discussed as a possibility---- some people like Wild Blue and others like Hughs.net.  A discussion was held. Council Member Keith Mellott was told to get the company from the internet service here to see what the possibilities are for the Municipal Building --- to see what provisions we can have here and to see what it would involve to get the internet service. 

 

Highway Garage

 

            The town is looking at the bids that were sent out in 2004 for renovation to the old highway garage.  The guys at the highway garage think that there is enough of the garage that is in good enough shape, that it could be made viable with out building up at the salt and sand shed site.   A discussion was held.  

           

Public Concerns

 

            Luke Paterson lives on Chamberlain Road off of Route 42, and he said the he had a gentleman that needed an address in order to stay out of prison because he was identified as a sexual offender for Greene County.  Mr. Paterson allowed him to use his address at his place, and was now apologizing to the town for not finding out more about  the details of his felony, but assured the town that he is not living with him now and won’t be in the future.   A discussion was held.

 

            Nicholas Palermo asked about the Town Board vote that was taken for approving the Revaluation / Reassessment for the town, and it was reported to him:  4 were aye; and 1 was nay.  Council Member Nelson told Mr. Palermo that he voted nay.   A discussion was held on the reassessment that will be taking place for the town.

PAY THE BILLS

 

            On a motion by Council Member Paul Van Valkenburgh, seconded by Council Member Lynn Byrne, the following resolution was

ADOPTED - Ayes - 5 - Baldrey, Nelson, Byrne, Van Valkenburgh, Mellott.

                      Nay - 0

 

            Resolved that this Town Board, having audited the following General Fund Vouchers #137 through #163, inclusive, hereby, orders them paid and directs the Town Clerk to draw Abstract #6, General Fund, on the Supervisor for payment of $11,623.51.

 

            Resolved that this Town Board, having audited the following Highway Fund Vouchers #61 through #73, inclusive, hereby, orders them paid and directs the Town Clerk to draw Abstract #5 Highway Fund, on the Supervisor for payment of $23,730.64.

 

Resolved, that this Town Board, having audited the following Special Lighting Fund Voucher #6, inclusive, hereby, orders it paid and directs the Town Clerk to draw Abstract #4 Special Lighting District Fund, on the Supervisor for payment of $176.41.

            Council Member Lynn Byrne made a motion to adjourn the meeting, seconded by Council Member Paul Van Valkenburgh.  All agreed.

 

            Supervisor Dixie Baldrey adjourned the meeting.
