Town Board Meeting

June 2, 2009

The Regular Meeting of the Town Board of the Town of Lexington was called to order on June 2, 2009 at 7:00 P.M., by Supervisor Dixie Baldrey at the Lexington Municipal Building, followed by the pledge of allegiance.

A moment of silence was observed for a long time town resident, Leonard Haines.

RESOLUTION #71-09
ACCEPT THE MINUTES

                On a motion by Council Member Lynn Byrne, seconded by Council Member Paul Van Valkenburgh, the following resolution was
ADOPTED - Ayes - 5 - Baldrey, Byrne, Mellott, Nelson, Van Valkenburgh
                    Nays - 0

This Town Board resolves to accept the minutes of the following meetings that were held:
                    Special Meeting – April 7, 2009 (Veterans Memorial)
                    Public Hearing – April 24, 2009 (Grant)
                    Special Meeting – April 24, 2009 (Ambulance)
                    Regular Meeting – May 5, 2009 (Regular)
                    Special Meeting – May 15, 2009 (Ambulance)

Financial Report

                Supervisor Dixie Baldrey presented the financial report to the Town Board Members for their review and explained the transfer that were needed.    
A discussion was held on the CD’s and where they are being held, and it was also suggested that maybe the town should consult a financial advisor for their funds. 

RESOLUTION #72-09
APPROVE FINANCIAL REPORT

                On a motion by Council Member Lynn Byrne, seconded by Council Member Maurice Nelson, the following resolution was

                    Nays - 0

                It is resolved that this Town of Lexington Town Board approves the Financial Report ending May, 2009.
               
RESOLUTION #73-09
TRANSFER / GENERAL FUND

                On a motion by Council Member Keith Mellott, seconded by Council Member Paul Van Valkenburgh, the following resolution was
ADOPTED - Ayes - 5 - Baldrey, Byrne, Mellott, Nelson, Van Valkenburgh
                    Nays – 0

                This Town Board moves to make the following transfer in the General Fund;
                                                From: Contingency Account (A1990.4) -- $50.00
                                    To:  Municipal Dues (A1920.4) --------- $50.00
Crump Hill Road

                Supervisor Dixie Baldrey and Supt. of Highways Larry Cross went with the Town Attorney to Kingston to give depositions regarding Crump Road.  It is believed that there will be a motion for dismissal during this month and it should go to the Judge in June, so therefore, Attorney Tal Rappleyea thinks the case should be done by the fall.

Ambulance Meeting

A meeting had been set up for June 4th, 2009 at 7:00 pm and at the typing of these minutes ---- the meeting has been cancelled because Ashland could not get three board members together.  

Lexington Park Meeting

                Councilmember Lynn Byrne announced that a Park Meeting will be held on Friday, June 5th, 2009 at 4:30 pm at the park site on (Main Street) County Rt. 13A, Lexington, NY 12452.

Cell Tower

                Supervisor Dixie Baldrey asked the Town Board Members if they would like to go forward with the Cell Tower on Town of Lexington Property.  Supervisor Baldrey asked the members what their feelings were:   Council Members Keith Mellott & Lynn Byrne were for putting up the tower, but did not like the location, which is behind the Municipal Building.  Council Members Paul Van Valkenburgh & Maurice Nelson said that they were in favor of the cell tower and would like to pursue the location behind the Municipal Building.  Further discussion was held.  Items discussed were the health hazards and the location.   There was no opposition to the cell tower itself, but there was concern about the location and if it is health hazard.

Informational Meeting

                An Information Meeting was set up to discuss the Cell Tower issue for Tuesday, June 16th, 2009 at 7:00 pm.

Community Waste Water Management Program 

                A meeting will be held on June 17th, 2009 for the CWC “Community Waste Water Management Program” at 7:00 pm.   (The meeting was originally scheduled for June 10, 2009 and was changed.)

Highway Garage Roof

                Supervisor Dixie Baldrey reported that the roof on the Highway Garage on Route 42 has been redone and completed by the contractor, John Berger.  He also fixed the so called dog houses at the rear of the building where the sanders protrude from the building in the winter in order to fit the trucks in the garage.   A door was also installed on the end of the garage which was required from the Dept. of Labor for safety reasons. 

Salt Shed Roof

                The Town of Lexington Highway Department Salt Shed needs their roof repaired because some shingles had blown off.  Doug Vandeusen was the engineer for the project when it was constructed and said that Park Lane Construction did the roofing.   After letters going back and forth, the Park Lane Construction & Development Corp., 10269 Old Route 31W, Clyde, NY 14433, gave a price of $500.00 to come to Lexington and do the work for the replacement of shingles, which they estimated to be about ½ of what the job would normally cost.   Engineer Doug Van Duesen replied with an e-mail saying that he thought the estimate seemed very reasonable for the fact that the price included 2-square of shingles furnished at no-charge.  A discussion was held.

RESOLUTION #74-09
REPAIR SALT SHED ROOF

                On a motion by Council Member Paul Van Valkenburgh, seconded by Council Member Maurice Nelson, the following resolution was
ADOPTED - Ayes - 5 - Baldrey, Byrne, Mellott, Nelson, Van Valkenburgh
                    Nays – 0

                This Town Board resolves to approve the price of $500., which was received from Park Lane Construction & Development to repair and replace the shingles on the Salt Shed Roof, which is located on County Rt. 13, Town of Lexington.

Bridgework on Route 42

                Supervisor Dixie Baldrey said that she received a call from NYS DOT saying they would be working on the three bridges (painting & stucco work underneath) on Route 42 for most of the summer. 

RESOLUTION #75-09
PARTICIPATE IN GREENE COUNTY BID PRICES

On a motion by Councilmember Lynn Byrne, seconded by Councilmember Keith Mellott, the following resolution was
ADOPTED.
                Ayes 5 -- Baldrey, Mellott, Van Valkenburgh, Nelson, Byrne.
                Nays – 0

                WHEREAS, Greene County has advertise for bids for supplies and materials to be used in highway construction and awarded contracts for the same;

                THEREFORE, BE IT RESOLVED, that the Town of Lexington does hereby participate in the purchase of supplies and materials subject to the rules, adopted by the County pursuant to Section 408-a of the County Law.

Oil Burner / Repair

                Supervisor Dixie Baldrey said that there has been work on the furnace and the bill has been included in the June bills, but it still needs a bearing in the circulator, which has been ordered.

Sump Pump

                The sump pump in the basement is not working, and Glenn Howard offered to look at it and fix it if it is necessary. 

Summer Arts Program

                Supervisor Dixie Baldrey said that she had a request for the Summer Kids Art Program that was held on the alternate days last year with Susan Walsh, which was along with the swim program.    There isn’t funding in the budget for this, but Supervisor Baldrey wanted to see if the Town Board Members approved it if  she could find some outside funding for the art program. 
                Council Member Byrne said she was all for it, but thought that at this time --- the town should really consider how the non-residents fit into their participation of these programs.   Supervisor Dixie Baldrey said that these decision need to be made soon, and Council Member Byrne said that she would find out what the Town of Hunter & Village of Tannersville charge when they have non residents participating.  A discussion was held and it was mentioned that it should be done soon because the children would be registering this month.

FIND FUNDING FOR THE SUMMER ART PROGRAM

On a motion by Councilmember Keith Mellott, seconded by Councilmember Lynn Byrne following resolution was
ADOPTED.
                Ayes 5 -- Baldrey, Mellott, Van Valkenburgh, Nelson, Byrne.
                Nays – 0

                This Town Board gives approval to Supervisor Dixie Baldrey to find the outside funding   for the “Summer Art Program”, which will be held in conjunction with the Summer Youth Program.  

Handyman

                It was decided at a previous meeting to hire Scott from Jewett, but he was not available because he was to busy.    Therefore, Lawrence Ludwig, from 1350 North Beech Ridge Road, was in the Municipal Building for other business and inquired about the handyman job because he was interested.   Supervisor Dixie Baldrey told him to give her his name and qualifications, which was given to the Board Members’, and then the Supervisor asked the Town Board Members if they would like him to do the handyman work around the Municipal Building. .

HIRE HANDYMAN

On a motion by Councilmember Paul Van Valkenburgh, seconded by Councilmember Maurice Nelson, the following resolution was
ADOPTED.
                Ayes 5 -- Baldrey, Mellott, Van Valkenburgh, Nelson, Byrne.
                Nays – 0

                This Town Board moves to hire Lawrence Ludwig on a job to job basis to do the miscellaneous jobs at the Town of Lexington Municipal Building.          

Public Concerns

                Taris Charysyn asked when the proper time was for the Town Board to see about the grade of sand that will be used on the roads this winter. 

                John Sturman said that the cell tower brought a thought to his mind that maybe the town should invest in wind mills.  A discussion was held.

DONATION TO AMERICAN LEGION / FLAGS

                On a motion by Council Member Lynn Byrne, seconded by Council Member Paul Van Valkenburgh, the following resolution was
ADOPTED - Ayes - 5 - Baldrey, Nelson, Byrne, Van Valkenburgh, Mellott.
                     Absent - 0                  
                     Nay – 0

                This Town Board moves to give a donation of $100.00 to the American Legion in Prattsville, NY because they struggle to buy flags for the veteran’s graves in the various cemeteries in the area each year. 

RESOLUTION #79-09
AUDIT THE BILLS

                On a motion by Council Member Paul Van Valkenburgh, seconded by Council Member Keith Mellott, the following resolution was
ADOPTED - Ayes - 5 - Baldrey, Nelson, Byrne, Van Valkenburgh, Mellott.
                     Absent - 0                  
                     Nay - 0

                Resolved that this Town Board, having audited the following General Fund Vouchers #93 through #120, inclusive, hereby, orders them paid and directs the Town Clerk to draw Abstract #6, General Fund, on the Supervisor for payment of $ 33,786.35.

                Resolved that this Town Board, having audited the following Highway Fund Vouchers #65 through #76, inclusive, hereby, order them paid and directs the Town Clerk to draw Abstract #6 Highway Fund, on the Supervisor for payment of $ 7,630.58.

                Council Member Maurice Nelson made a motion to adjourn the meeting, seconded by Council Member Lynn Byrne.  All agreed.
