Planning Board Meeting
May 8th, 2007
Chairman, Glenn Howard called the regular monthly meeting to order on May 8, 2007 at the Lexington Municipal Building, Route 42, followed by the pledge of allegiance to the American Flag. Planning Board members present were Chairman Glenn Howard, Susan Constable, Ralph Albino, Robert Cross, Jr., Edwin Dippold, Jr., and Robert Hermance. Absent was Taris Charysyn, Others present were Odarka & Eustachy Begej, and Rose Williams, Secretary. MINUTES Vote: Howard-aye, Hermance-aye, Dippold-aye, Albino-aye, Constable-aye, Cross-aye. Carried. Absent: Charysyn Begej Minor Subdivision - Odarka & Eustachy Begej – Across from Mahoney Beech Ridge # 1 Parcel # 144.00-1-3 == 121.10 Acres 5 Acres with the house subdivided from the total acreage. Odarka & Eustachy Begej attended the meeting to ask questions regarding their minor subdivision and said that they would like clarification on some things. Things they wanted to know were:
1. Where they need to put the driveway for the subdivided parcel. Chairman Howard explained where the proposed driveway should be put on the map, and the members believe that there is an existing culvert already there. 2. Do they need to show a driveway on both sides of the road? The answer was yes. 3. What is the minimum lot size for a parcel that is being subdivided? It is 3 acres for rural residential and 10 acres for conservation. 4. What part do they need to survey? The whole parcel or only the part that is being subdivided out from the original piece? Chairman Howard said that the parcel that is being subdivided out needs to be surveyed, and put other existing points on an existing map if you have one. Things that should be put on the survey map are: a. Contour lines 100 feet apart on map. b. Any easements c. Any right-of-ways d. Where the house is located e. Where the septic is located f. Distance of road frontage g. Where the well is located 5. Can they increase the amount of land in the future, if the buyer of the house would like more acreage with the house. The Planning Board Members said that the should increase the property size before they come in for Preliminary Plat Approval, but could also do a lot line adjustment after the approval --- if they wanted to add land to the house parcel. The law states that one can subdivided four parcels within a three year time frame, and more that four is considered a major subdivision) 6. How long does it take between Preliminary Plat Approval and Final Approval, and the answer was one month. 7. There are two septic systems, a new one and old one, so they were told to make sure that the new septic is on the correct parcel with the house that you are subdividing. 8. Is it public information to look at a map and see the adjoining land owners that surround the property? The answer was yes.
Further discussion was held on the minor subdivision. Chairman Howard said the next meeting for the Begej’s --- would be for them to bring the survey maps for preliminary plat approval, and then a public hearing could be scheduled for the final approval Code Enforcement Violations Chairman Howard said that Code Enforcement Officer, James Boyle, issued violations, and said that the camper issue in the law is vague, and needs redefining. They need a new definition of camping – It now says, “There shall be no camping by any person for a period in excess of 14 consecutive nights in the same location in the same calendar year.” Apparently, if a guy moved his camper ten feet --- to a new location – he could continue to use it. A discussion was held on redefining camping in the Zoning Law. Chairman Howard said that he would write “There shall be no camping by any person in excess of 14 consecutive nights on the same property in the same calendar year --- anything over 14 nights would require a special use permit, which would be good for a period of six months. More discussion was held and Chairman Howard said that he would write something up for approval by the Planning Board, so that it can be presented to the Town Board. Training Edwin Dippold Jr. wasn’t to the last meeting and asked about how the Planning Board is going to do the four hour training that is required of them for this calendar year. Chairman Howard said that anyone can document what ever they read or participate in by completing a form that documents what they did --- and the Town Clerk will keep a file. Robert Hermance completed his four hours of training for 2007 and it will be kept on file In the Town Clerk’s office.
