Local Law No. 1 of 2007

The Town of Lexington Town Board opened the meeting for the Public Hearing on Local Law No. 1 of 2007 on March 22, 2007 at 6:30 PM at the Lexington Municipal Building, 3542 Route 42, Lexington, New York.

The Public Hearing Notice was advertised in the local newspaper, the Windham Journal the week of February 15th, 2007, and it is so stated into this record. The Public Notice read as follows:
“Notice is hereby given that a public hearing will be held by the Town of Lexington Town Board at the Lexington Municipal Building on Thursday, February 22, 2007, at 6:30 PM concerning proposed Local Law No. 1 of 2007, entitled, “A Local Law Establishing Income Levels for Real Property Taxes for Disabled and Low Income Citizens”, where it would be enacted pursuant to the requirement set forth in the New York State Real Property Tax Law § 459-e to establish real property tax income levels for disabled and low income citizens. At such time and place, all persons interested in the subject matter thereof will be heard concerning the same. A copy of the proposed local law can be obtained at the Town Clerk’s Office during office hours.”

Supervisor Dixie Baldrey opened the Public Hearing for Local Law No. 1 of 2007 and read the law to the public, and asked the public if they had any comments or questions. No comments or questions were made.

Councilmember Lynn Byrne made a motion to close the public hearing, seconded by Councilmember Paul Van Valkenburgh. Time: 6:35 PM ---- All Agreed
Supervisor Dixie Baldrey closed the public hearing.

RESOLUTION #29-07
ADOPT LOCAL LAW N0. 1 OF 2007

On a motion by Councilmember Paul Van Valkenburgh, seconded by Councilmember Keith Mellott, the following resolution was
ADOPTED. Aye: 5 - Baldrey, Van Valkenburgh, Mellott, Byrne, Nelson.
Nay: 0

This Town Board moves to adopt Local Law No. 1 of 2007 which follows in it entirety:

LOCAL LAW NO. 1 of 2007
TOWN OF LEXINGTON

“DISABLED AND LOW INCOME CITIZEN
REAL PROPERTY TAX EXEMPTIONS”

Be it enacted by the Town of Lexington as follows:

Section 1. Title

This Local Law shall be known as “A Local Law Establishing Income Levels for Real Property Taxes for Disabled and Low Income Citizens.”

Section 2. Authorization

This local law is enacted pursuant to the requirements set forth in the New York State Real Property Tax Law §459-c to establish real property tax income levels for disabled and low income citizens.

Section 3. Exemption Levels

The Town of Lexington hereby adopts as the maximum level of income for persons eligible for the within exemption as $18,000.00 (Eighteen Thousand Dollars). The “sliding scale” provisions of New York Real Property Tax Law §459(c) are also hereby adopted.

Section 4. Repealer

Any prior local law currently in existence which is inconsistent with the terms of this local law is hereby repealed.

Section 5. Effective

This Local Law shall take effect immediately in accordance with the requirements of the New York State Municipal Home Rule Law.

“SENIOR CITIZEN REAL PROPERTY TAX EXEMPTIONS”

Be it enacted by the Town of Lexington as follows:

Section 1. Title

This Local Law shall be known as “A Local Law Establishing Income Levels for Real Property Taxes for Senior Citizens.”

Section 2. Authorization

This local law is enacted pursuant to the requirements set forth in the New York State Real Property Tax Law § 467 to establish real property tax income levels for citizens who are 65 (sixty-five) years of age or older.

Section 3. Exemption Levels

The Town of Lexington hereby adopts as the maximum level of income for persons eligible for the within exemption as $18,000.00 (Eighteen Thousand Dollars). The “sliding scale” provisions of New York Real Property Tax Law §467 (1)(b)(1) are also hereby adopted.

Section 4. Repealer

Any prior local law currently in existence which is inconsistent with the terms of this local law is hereby repealed.

Section 5. Effective

This Local Law shall take effect immediately in accordance with the requirements of the New York State Municipal Home Rule Law.

Councilmember Paul Van Valkenburgh made a motion to adjourn the meeting for the public hearing, seconded by Council Member Maurice Nelson. All agreed.
