Planning Board Meeting

FEBRUARY 13, 2007

Deputy Chairman, Robert Hermance called the regular monthly meeting to order on February 13th, 2007 at the Lexington Municipal Building, Route 42, followed by the pledge of allegiance to the American Flag.

Planning Board Members present were Deputy Chairman Robert Hermance, Susan Constable, Edwin Dippold, Jr., and Ralph Albino. Absent were Robert Cross, Jr., Taris Charysyn, and Glenn Howard.

Others present was Rose Williams, Secretary.

MINUTES

Edwin Dippold, Jr. made a motion to accept the minutes of the regular meeting of January 9th, 2007, seconded by Ralph Albino.

Vote: Hermance-Aye, Dippold-Aye, Albino-Aye, Constable- Aye. Carried.

Absent: Charysyn, Howard, & Cross.

Minor Subdivision – Begej, Odarka & Eustachy (Former Owner / Marian Kots)

Beech Ridge Road #1 – Across from John Mahoney

Parcel #144.00-1-3 = 121.10 Acres

Sketch Plan – Subdivide 5 acres and house from total acreage

Deputy Chairman Robert Hermance had an application from Begej asking for a minor subdivision where they would like to subdivide five acres and a house from the original 121 +/- acres. The meeting was opened for discussion. Edwin Dippold said that he would like to have someone from the Town of Lexington Highway Committee look at the site to see if there is a place for a driveway on the remaining property. The Town of Lexington Highway Committee consist of: Supt. of Highways - Larry Cross, Paul Van Valkenburgh, Glenn Hapeman, Keith Mellott, and Edwin Dippold. Next, Deputy Chairman Hermance said that he would contact the Highway Committee and go to Beech Ridge #1 to view the site to see if they would have suitable access from both sides of the road. The remaining acreage will become one parcel, which will extend to both sides of Beech Ridge Road #1, and it was noted that there is a barn on the opposite side of the road, which would probable go with the remaining property.

Edwin Dippold said that he was concerned about the site distance and the owner should be made aware of these things, in case they would like to subdivide the remaining property in the future. A discussion was held on whether they needed a driveway on the remaining acreage or not, but it would depend on what they plan on doing with the remaining acreage.

Edwin Dippold, Jr. made a motion to contact the Highway Committee for the Town of Lexington to make sure that there is suitable access from both sides of the road, seconded by Susan Constable.

Vote: Hermance-Aye, Dippold-Aye, Albino-Aye, Constable- Aye. Carried.

Absent: Charysyn, Howard, & Cross.

The Planning Board asked the Secretary, Rose Williams, to ask the owner if they would like to have or need a driveway on the remaining acreage, and the Planning Board Members felt that they didn’t have enough information to give Sketch Plan Approval.

Edwin Dippold, Jr. made a motion not to take any action on the Sketch Plan Approval until the Town Highway Committee makes their decision on the access to the property; and what the road frontage has to be and/or what the site distance has to be; so that the remaining property is not land locked, seconded by Susan Constable.

Vote: Hermance-Aye, Dippold-Aye, Albino-Aye, Constable- Aye. Carried.

Minor Subdivision – Concato – Van Etten Road Extension – Preliminary Plat

Parcel # 109.00-2-48 – 10 +/- Acres (Subdivide into two Parcels)

Lot # 1 = 5.126 Acres

Lot # 2 = 5.126 Acres

Representative from Attorney Office of Kaplan & Brennan

No representative was present for the Concato Minor Subdivision; therefore the Planning Board Members felt that the Preliminary Plat Approval should be tabled until next month because a survey map is needed to continue. The members discussed what lots were being subdivided because Chairman Hermance went up to look at the property.

Parcel # 109.00-2-48 of 10.25 acres is being subdivided. into two parcels.

The Planning Board members said that they would need a survey map for the next meeting to give Preliminary Plat Approval and then a Public Hearing could be scheduled, and the adjoining property owners would be notified of said hearing by the secretary.

Ray Albino made a motion to table the Concato Minor Subdivision until next month because no one showed up with the survey map and information seconded by Susan Constable.

Vote: Hermance-Aye, Dippold-Aye, Albino-Aye, Constable- Aye. Carried.

Susan Constable made a motion to adjourn the meeting, seconded by Edwin Dippold, Jr. Everyone Agreed.

Deputy Chairman Hermance adjourned the meeting.
