Board Meeting-Year End Meeting of the Town Board

December 29, 2010

The Year End Meeting of the Town Board of the Town of Lexington was called to order on December 29, 2010 at 6:30 P.M., by Supervisor Greg Cross at the Lexington Municipal Building, followed by the Pledge of Allegiance.

Resolution # 161-10
Approve Minutes

            On a motion by Council Member Lynn Byrne, seconded by Council Member Glenn Howard, the following resolution was

            This Town Board moves to approve the minutes of the Regular Meeting held on December 7, 2010.  

RESOLUTION # 162-10
APPROVE TRANSFERS / GENERAL FUND

            On a motion by Council Member Keith Mellott, seconded by Council Member Glenn Howard, the following resolution was

                     Nays – 0

            This Town Board of the Town of Lexington moves to make the following transfer in:
General Fund – From: Special Acct. Contingent, (A1910.4) ========= $ 1200.00
                                              To:  Town Board, Contractual (A1010.4) ========= $    750.00
                                                     Town Clerk, Contractual (A1410.4) ========== $   450.00
                                          From:  Justice, Clerk (A1110.11) ========= $ 500.00
                                                  To:  Justice, Contractual (A1110.4) ===== $ 500.00
                                                        From:   Code Enforcement, Equipment  (A3620.2) == $ 600.00

Ambulance Funds

            Supervisor Greg Cross said there was money left  in the Rescue Squad Fund (A3625.0) and he would like to have it set up in a special fund to carry over to next year -- the sum of $55,008.32.  Supervisor Cross suggested opening up a Money Market Account and ear marking it so that it only gets used for Ambulance Funding.
            Supervisor Greg Cross will check with the Town Attorney to see if there is a special way to set the funds aside – like a Reserve Account.  

RESOLUTION # 163-10
Account for Rescue Squad Funds / 2010

            On a motion by Council Member John Berger, seconded by Council Member Glenn Howard, the following resolution was
ADOPTED - Ayes - 5 - Cross, Byrne, Mellott, Berger, Howard
                    Nays – 0

            This Town of Lexington Town Board moves to open a Special Account for the remaining funds in the 2010 Budget under the Rescue Squad Account A3625.0 which has an amount of $55,008.32.

Organizational Meeting – is scheduled for January 4th, 2011 @ 7:00 pm.

Inventory Report – 2010

            Inventory Clerk Christine Dwon presented her Inventory Report dated 12/21/10 for completion for the 2010 year, and sent a letter saying that she does not want to do Inventory Clerk in the future.

Accept Inventory Report / 2010

            On a motion by Council Member Lynn Byrne, seconded by Council Member John Berger, the following resolution was

            This Town Board moves to accept the Inventory Report of 2010 for the Municipal Building and the Highway Garage.

Monthly Report – Code Enforcement

            Supervisor Greg Cross said that everyone was given a Code Enforcement Report for December, 2010.

Columbia-Greene Humane Society

            On a motion by Council Member Keith Mellott, seconded by Council Member Lynn Byrne, the following resolution was
ADOPTED - Ayes - 5 - Cross, Byrne, Mellott, Berger, Howard
                     Nays – 0

            This Town of Lexington Town Board moves to accept the agreement with the Columbia-Greene Humane Society / SPCA, which covers a period from January 1, 2011 through December 31, 2011.

RESOLUTION #166-10
Re-Appoint BAR Member

            On a motion by Council Member Glenn Howard, seconded by Council Member Keith Mellott, the following resolution was
ADOPTED - Ayes - 5 - Cross, Byrne, Mellott, Berger, Howard
                     Nays – 0

            This Town of Lexington Town Board moves to re-appoint John Loftus as a member of the Board of Assessment & Review with a term which will be retroactive back to September 1, 2010 and expire on  September 30, 2015

Burner

            Supervisor Cross said that he has determined what needs to be replaced on the burner and would have it taken care of, and the town will pay for the labor and not the part.

Board Approval

            Supervisor Greg Cross said that everyone needs to get Town Board approval to establish an account which Karen Deeter referred to as a holding account for the bicentennial funds they have been raising.  He was alarmed when the bank called him and said that Karen was there trying to set the account up herself.   Supervisor Cross explained to her why he got the call and that it was really not her job, so therefore, Supervisor Greg Cross said that he would like to get the Town Board’s approval because she has around one thousand dollars that she needs put into a holding account for the historical funds until she sets something up with the Greene County Historical Association.

Account for Bicentennial Funds

            On a motion by Council Member Glenn Howard, seconded by Council Member John Berger, the following resolution was
ADOPTED - Ayes - 5 - Cross, Mellott, Berger, Howard, Byrne

            This Town of Lexington Town Board resolves to set up a holding account at the bank for Historian Karen Deeter to deposit checks she has received for the Historical Bicentennial Celebration which is coming up in 2013 for the Towns Celebration of its Two-Hundredth Birthday.

Correspondence

            Received a Resolution from Greene County Legislatures where they will help out on the charge backs every year for four years because they will pick up 25% of the amount every year for the charge backs until they take over all of them. 

            For a follow-up on the flood, Supervisor Greg Cross said that he has a meeting scheduled attentively for the first part of January with Greene County Soil & Water and they are going to send a guy named Joel up from Cairo to visit all the sites.  Many of the spots were named and discussed and Betty Hapeman asked if he could walk down Main Street with Joel and show him what the Schoharie does when the water get high.

            Supervisor Greg Cross said he wanted to make a quick review of the year and he was pretty proud of what the Town Board got accomplished this year – saying that they have streamlined the government of the town a great deal --- some positions have been let go --- the computer guy that was here on a monthly basis to do whatever he did was let go, and now we have computer repairs upon a needed basis now instead of paying someone just to come in monthly --- got a lot of volunteers --- Glenn spent numerous hours working on the oil tanks here and at the town garage --- John has worked on the roof and other miscellaneous things.   Councilmember Byrne said that the Board Members have always volunteered for a lot of things and not just this year.  Supervisor Greg Cross said that it was actually fine to Councilmember Byrne, and said that was perfectly fine, but Supervisor Cross went on to say that he would just like to thank them for their work.  Then he said that the highway guys have stepped up to the plate --- did away with the handyman around here and the sidewalks might not get shoveled quite as fast, but the guys had definitely stepped up and met the challenge and he appreciated that.  The budget was a reflection of what they had done and obviously there are people outside the town that recognize the work that is being done.   There was an article in the paper a couple of weeks ago, and it was a pretty good feeling to see that people see what the town is doing here and he was proud of that and he hoped the board was proud of it and the town proud of it, and with that being said ……
Supervisor Cross said that one thing he could not take Lynn was …. “Here is a voucher from last month’s bills that you couldn’t sign because you had to excuse yourself.  Next, Supervisor Cross said that he stands staring at the ceiling many a nights wondering how he could save the taxpayers of this town money, and he would not sign the voucher because he personally believes it is either a personal of political agenda that has cost the town three hours of the town attorney’s time.  This was not discussed at a board meeting, and when you solicited information from the town attorney --- it cost the town three hours of his time, and he personally thought that if it doesn’t represent the majority --- he thought that it was out of line.  And with that being said; Supervisor Cross addressed Councilmember Byrne saying that her signature would be the last signature required to pay that bill, or if she choose not to sign it --- it would not get paid.   Next, Supervisor Cross told Councilmember Byrne that she should be ashamed of herself ---- and that he personally felt that and went on to say that it was his opinion.  Supervisor Greg Cross said that as far as this political game that was being played here month after month after month --- you know it is what it is --- you guys know the course you need to take moving forward – you should either take the course outside this office and outside these meetings, and he would meet the challenge ----- so let’s do town business in the town – the town hall.
Council Member Lynn Byrne asked Supervisor Cross if he was done reprehending her and Supervisor Greg Cross answered by saying, yes - he was, and then Supervisor Cross asked for a motion to adjourn the meeting.

PAY THE BILLS

            On a motion by Council Member Glenn Howard, seconded by Council Member Keith Mellott, the following resolution was
ADOPTED - Ayes - 5 - Cross, Byrne, Howard, Mellott, Berger
                    Nay – 0
                  
Resolved, that this Town Board, having audited the following General Fund Vouchers # ______ through # ______, inclusive, hereby, orders them paid and directs the Town Clerk to draw Abstract # 13, General Fund, on the Supervisor for payment of $ __________

Resolved, that this Town Board, having audited the following Highway Fund Vouchers # 218 through # 236, inclusive, hereby, orders them paid and directs the Town Clerk to draw Abstract # 13, Highway Fund, on the Supervisor for payment of $ 25,561.45

Adjourn

            Councilmember Lynn Byrne made a motion to adjourn the meeting, seconded by Councilmember Keith Mellott.  All agreed.
