A Public Hearing for the Preliminary Budget of 2009

A Public Hearing for the Preliminary Budget of 2009 of the Town Board of the Town of Lexington, County of Greene and State of New York was held at the Municipal Building, 3542 Route 42, Lexington, NY on the 5th day of November, at 6:30 p.m. followed by the pledge of allegiance.

            The notice for the Preliminary Budget Hearing was published in the Windham Journal the week of October 23rd, 2008 and copies of the 2009 Preliminary Budget were available for the public.

            Supervisor Dixie Baldrey said that she had comments from Gregg Cross regarding the 2009 Preliminary Budget and would like to address his concerns, but first had too open the Public Hearing to see if there were any comments from the public on the budget.    Time: 6:30 PM

            Supervisor Dixie Baldrey opened the Public Hearing for the 2009 Preliminary Budget by the Town of Lexington Town Board, and asked the public if they had a comments or questions on the 2009 Budget for the Town of Lexington.  There were no comments from the public, so therefore Supervisor Dixie Baldrey went on to discuss the budget with the Town Board Members. 

Board Discussion

            Supervisor Dixie Baldrey said early that Greg Cross came to her with questions regarding the benefits in the budget and she wanted to address them with the Town Board Members.  The items that were discussed were:

General Fund, A9030.8 = Social Security, and

Highway Fund, DA9010.8 = State Retirement and DA9030.8 = Social Security.

They discussed changing and lowering:

A9030.8 (Social Security) from $13,000. to 12,500.

A9060.6 (Health Insurance) from $20,000. to $18,000. --- Wasn’t sure about this one

because the financial report said that  

$18,000 was spent already for this year.

DA9010.8 (State Retirement) from $20,000. tp $17,500.

DA9030.6 (Social Security) form $14,000. to $12,000.

Supervisor Dixie Baldrey asked again if there were any comments or questions from the general public; and there was no response, so Supervisor Dixie Baldrey asked for a motion to close the Public Hearing.

Motion to Close Public Hearing

            Councilman Keith Mellott made a motion to close the Pubic Hearing for the Budget Hearing, seconded by Council Member Maurice Nelson.  Time -- 6:52 pm

Vote:  Baldrey-aye, Nelson-aye, Van Valkenburgh-aye, Byrne-aye, Mellott-aye.  Carried.

            Supervisor Dixie Baldrey closed the Public Hearing for the Preliminary Budget of 2009 at 6:53 pm.

Adjourn Meeting

            Councilman Maurice Nelson made a motion to adjourn the Preliminary Budget Hearing for 2009 for the Town of Lexington, seconded by Councilwoman Lynn Byrne.

Vote:  Baldrey-aye, Nelson-aye, Van Valkenburgh-aye, Byrne-aye, Mellott-aye.  Carried.

Supervisor Dixie Baldrey adjourned the meeting for the Preliminary Budget for 2009.

The Regular Meeting of the Town Board of the Town of Lexington was called to order on November 5, 2008 at 7:00 P.M., by Supervisor Dixie Baldrey at the Lexington Municipal Building, followed by the pledge of allegiance.

            A moment of silence was observed in memory of Muriel Samuelsen, and Percy Goff.

RESOLUTION #123-08

TRANSFERS – GENERAL FUND

On a motion by Council Member Keith Mellott, seconded by Council Member Paul Van Valkenburgh, the following resolution was

            This Town Board moves to make the following transfer in the General Fund:

                                    From: Justice, Contractual (A1110.4) == $800.00

                                        To: Justice, Clerk (A1110.11) == $800.00

                                       From: Supervisor, Contractual (A1220.4) == $1000.00

                                           To: Supervisor , Equipment (A1220.2) == $1000.00

FIRE DISTRICT BUDGET

            Supervisor Dixie Baldrey reported that she received the Fire District Budget and it was lower than it was in the previous year, and the amount to be raised in taxes for the year 2009 was $83,000.

 

Budget Change

            Supervisor Dixie Baldrey said that Historian did not receive her stipend for the 3.5 increase, so therefore $14.00 should be added to A7510.1 line item, which would make it a total of $414.00.

RESOLUTION #124- 08

CHANGES IN THE PRELIMINARY BUDGET FOR THE 2009 BUDGET

            On a motion by Council Member Paul Van Valkenburgh, seconded by Council Member Lynn Byrne, the following resolution was

ADOPTED.  Aye – 5 – Baldrey, Van Valkenburgh, Mellott, Nelson, and Byrne.

                    Absent – 0

            This Town Board moves to revise the following line items in the 2009 Budget, which will be adopted by the Town Board.

                        General Fund

                                    Set Line Item  A7510.1 (Historian, Personnel) == $414.

                                       Set Line Item  A9030.8 (Social Security) == $12,500.

                        Highway Fund

                                    Set Line Item  DA9010.8 (State Retirement) == $17,500

                                    Set Line Item  DA9030.8 (Social Security) == $12,000.

            This Town Board hereby adopts the 2009 Town of Lexington General Fund Budget of : Appropriations: $394,208., Less Estimated Revenues of $74,140., Less Unexpended Balance of $40,000., for a Total Amount to be raised in the General Fund by Taxes of $280,068.

RESOLUTION #126-08

ADOPT “2009” HIGHWAY FUND BUDGET

            On a motion by Council Member Paul Van Valkenburgh, seconded by Council Member Keith Mellott, the following resolution was

ADOPTED.  Ayes 4 – Baldrey, Byrne, Van Valkenburgh, Nelson, & Mellott.

                    Absent 

                    Nays 0

            This Town Board hereby adopts the 2009 Town of Lexington Highway Fund Budget of:  Appropriations: $539,272., Less Estimated Revenues of $76,000., Less Unexpended Balance of $20,000., for a Total Amount to be raised in the Highway Fund by Taxes of $443,272.

RESOLUTION #127-08

ADOPT “2009” SPECIAL LIGHTING DISTRICT

          On a motion by Council Member Lynn Byrne, seconded by Council Member Maurice Nelson, the following resolution was

ADOPTED.  Ayes 5 -- Baldrey, Byrne, Van Valkenburgh, Nelson, & Mellott

                   Absent - 0

                    Nays 0

            This Town Board hereby adopts the 2009 Town of Lexington Special Lighting District Fund at $2,000., for a Total Amount to be raised in the Special Lighting District Fund by Taxes at. $2,000.

Deer Pen Estates Roads – Dan Fancher

            Dan Fancher, from RETTEW Engineering said that he came to the meeting to give the town an update on what was happening with the Deer Pen Estate Roads and did not want the town to think that Sal Mancuso had forgotten about doing the road work.   A discussion was held on what they are planning to do.  Mr. Fancher said that they are not going to get to everything now , but would wait until Spring to start the major work.  They also discussed what type of monuments they would like to use on  the roads  .

Crump Hill

            Supervisor Dixie Baldrey said that the town was served with another summons that day regarding the Crump Hill litigation.  The Town Attorney was sent a copy and a discussion was held. 

Memorial Project

            Kevin VanHentenryck asked about what was happening with the Memorial that was discussed for the front of the Municipal Building.    Kevin said that his estimate was made on what was published and requested in the Windham Journal, which was $20,000., and it would be the Eagle’s Head.

           Supervisor Baldrey asked where the memorial would go, and Kevin’s idea was to combine the present memorial with the new one and push the flag pole out further because that was always in the way of the fire company pulling out of the garage. 

There was a discussion on how Kevin proposed to do the Memorial and the Board Members asked him to put together some drawings and draw up a sketch plan of his ideas so they would better understand what he was proposing.   Supervisor Baldrey said that she would like to see how the two memorials are coming together ---- would like a sketch, which he said that he would do for the next meeting.   Kevin Van Hentenryck also discussed the possibility of getting in kind services from contractors to do some of the work, like earth moving, drawing of dirt, and etc.  

There was also a discussion whether anything was ever finalized or voted upon at an earlier time, and what the wording was that had been discussed earlier --- wasn’t sure how it was suppose to read.  Further discussion was held. 

Mega Electric Service    

            MEGA – Municipal Electric & Gas Alliance  -- Supervisor Dixie Baldrey attended a Mountain Top Supervisor’s Meeting, which explained  where counties and/or  towns are joining together collectively to purchase gas or electric.  They do all of the bidding and prices which is included in the notes.  Supervisor Dixie Baldrey said that she would copy the paper work and get it to the Council Members for them to review, and felt that after review, the Board could consider it at the next meeting.   The Town of Ashland is in the program now.  

Lexington Village Cemetery

            The Town of Lexington received a letter from the Lexington Village Cemetery Association asking for assistance.  The Town is not allowed by law to give them any funds and the town doesn’t want to take it over.  A discussion was held. 

            Supervisor Dixie Baldrey said that she would write a letter to the Lexington Cemetery Association telling them that legally the town cannot  assist them, and if the town could support them in any other way – they would consider that.  

Scenic Byways Corridor Management Plan

            Supervisor Dixie Baldrey said that she would like the Town Board to read the letter to the Town of Hunter in supporting the Scenic Byways Corridor Management Plan. 

RESOLUTION #128-08

SUPPORT THE MOUNTAIN CLOVES SCENIC BYWAYS CORRIDOR MANAGEMENT PLAN

          On a motion by Council Member Lynn Byrne, seconded by Council Member Paul Van Valkenburgh, the following resolution was

            This Town Board of the Town of Lexington supports the Town of Hunter in the “Mountain Cloves Scenic Byways Corridor Management Plan”.

Rescue Squad Concerns

            Supervisor Dixie Baldrey said that Greene County is looking into a county wide rescue service and it would take time to develop.  Jewett, Ashland, Prattsville, and Lexington are out there by themselves, and Supervisor Baldrey wondered what should be happening next. 

Council Member Lynn Byrne said that the committee had served its purpose and that the fire budget was less because they knew that they are not going to have the rescue squad anymore, but a new ambulance was needed.  Council Member Lynn Byrne suggested having a special meeting with Dan King from Greene County Emergency, so he could come and speak with the town about some of the options that the town may have.    

Council Member Keith Mellott suggested that Supervisor Tompkins from the Town of Ashland should come to the meeting to explain the process that they use, and what there figures are for their operation, which seems to be working. 

A date will be set for either November 14th or 21st, to have Dan King come to the special meeting at 3:30 pm --- which ever day that Dan King can attend.   

            More discussion was held.

College Charge Backs -- Resolution

 

RESOLUTION #129 -08

OPPOSE CHANGES IN CHARGE BACK FORMULA

          On a motion by Council Member Lynn Byrne, seconded by Council Member Paul Van Valkenburgh, the following resolution was

ADOPTED.  Ayes 5 -- Baldrey, Byrne, Van Valkenburgh, Nelson, & Mellott

                   Absent - 0

            This Town Board of the Town of Lexington supports the Mountaintop Supervisors and Mayor Association in supporting of their opposition in any changes in the charge back formula as presented below.

            “WHEREAS, some municipalities in Greene County support changing the way charge backs are calculated for students that do not use the Columbia-Greene Community College to a system that divides the cost among all communities in the county; and

            WHEREAS, the Mountaintop Supervisors and Mayors Association (MSMA) at their October 27, 2008 meeting discussed the ramifications of such change to their communities; and

            WHEREAS, The MSMA feels dividing the charge backs equally across the county is inequitable and would like to maintain the current formula calculating charge backs on an individual town basis.

            NOW, THEREFORE BE IT RESOLVED,

            The Mountaintop Supervisors and Mayors Association (MSMA) opposes any changes to the current formula and respectfully request that the Greene County Legislature not adopt any changes to the policy governing student charge backs which would change the distribution of how these costs are paid.”   

Association of Towns Meeting in NYC – February 15th to 18th, 2009

Hughs.net – Council Member Keith Mellott said they faxed him over a price for the network set up.

Hugh’s Net Satellite System was 399.98 for the system, with a mail in rebate until 11/30/08 of -$100.00.   A discussion was held. 

PUBLIC CONCERNS

Cell Tower: Glenn Howard asked what was happening with the cell tower issue.  A discussion was

                    held, and Glenn Howard and Ray Albino will look into the cell tower for the town.

Hazard near Post Office Glenn Howard said that there is a hazard with the way the water is pump out

 of the basement into the street next to the post office in West Kill because it is always

freezing on the road – he felt that he should be made to pump it out the back of the house,

instead of the front.  

Snowmobile Club: Glenn Howard and Ray Albino said that their snowmobile club has been funded

            for six miles of trails and they have gotten their status for a non-profit organization, and the

             town will be getting a check because they are the sponsor for the club.   

Restoration Service:  Ray Albino said that the restoration service in this area is lousy and wanted to

            make a note of that.

Correspondence:  The Community Action of Greene County, Inc. would like the town to assist in

                                making their “Adopt a Family” Christmas Program a success.  Council Member

                                Lynn Byrne said that she would take any of the gifts to the High School for delivery 

      by them.   

      Received a letter from Governor Paterson announcing that New York faces a

      record $47 Billion Budget deficit over the next four years – largest in state history.

Resolved, that this Town Board, having audited the following General Fund Vouchers #279 through # 308, inclusive, hereby, orders them paid and directs the Town Clerk to draw Abstract # 11, General Fund, on the Supervisor for payment of $ 13,738.26

Resolved, that this Town Board, having audited the following Highway Fund Vouchers # 125 through # 143, inclusive, hereby, orders them paid and directs the Town Clerk to draw Abstract #10 Highway Fund, on the Supervisor for payment of $ 19,983.71

         Resolved, that this Town Board, having audited the following Special Lighting District Voucher # 10, hereby orders it paid and directs the Town Clerk to draw Abstract # 11, Special Lighting District Fund, on the Supervisor for payment of $ 202.96.
