Board Meeting - November 8, 2007

The Regular Meeting of the Town Board of the Town of Lexington was called to order on November 8, 2007 at 7:00 P.M., by Supervisor Dixie Baldrey at the Lexington Municipal Building , followed by the pledge of allegiance.

RESOLUTION # 112-07

AMEND THE MINUTES OF 10/2/07

On a motion by Council Member Paul Van Valkenburgh, seconded by Council Member Maurice Nelson, the following resolution was

This Town Board moves to amend the minutes of October 2, 2007 by correcting the amount of money in Resolution #100-07 to read -- $376.81- instead of $356.81 as stated., and:
It further moves to accept the minutes of October 2, 2007 after amending as stated above.

APPROVE  THE  MINUTES – 11/17/07

APPROVE THE FINANCIAL REPORT

On a motion by Council Member Lynn Byrne, seconded by Council Member Paul Van Valkenburgh, the following resolution was

It is resolved, that this Town Board shall accept the Financial Report of October 31, 2007, as presented by Supervisor Dixie Baldrey.

TRANSFER IN THE GENERAL FUND

On a motion by Council Member Keith Mellott, seconded by Council Member Lynn Byrne, the following resolution was

This Town Board moves to make a transfer in the General Fund:

From: Contingency, Contractual (A1990.4) == $292.46

To: Supervisor, Contractual (A1220.4) == $200.00

Tax Collection, Contractual (A1330.4) == 92.46

ADOPT  BUDGET FOR 2008 GENERAL FUND

On a motion from Councilmember Lynn Byrne, seconded by Councilmember Paul Van Valkenburgh, the following resolution was

ADOPTED.   Ayes 5 -- Baldrey, Byrne, Nelson, Mellott, Van Valkenburgh

                    Nays 0

Resolved, that this Town Board does hereby adopt  the General Fund Budget for fiscal year 2008 at $381,072., less Estimated Revenues of $70,075., less Unexpended Balance of $40,000., for a total of $270,997. to be raised by taxes.

RESOLUTION # 118-07

ADOPT BUDGET FOR 2008 HIGHWAY FUND

On a motion from Councilmember Maurice Nelson, seconded by Councilmember Lynn Byrne, the following resolution was

ADOPTED.   Ayes 5 -- Baldrey, Byrne, Nelson, Mellott, Van Valkenburgh

                    Nays 0

Resolved, that this Town Board does hereby adopt the Highway Fund Budget for fiscal year 2008 at  $530,454., less Estimated Revenues of $74,000., less Unexpended Balance of $10,000., for a total of $446,454., to be raised by taxes.

RESOLUTION # 119-07

ADOPT BUDGET FOR 2008 SPECIAL LIGHTING DISTRICT FUND

On a motion from Councilmember Keith Mellott, seconded by Councilmember Paul Van Valkenburgh, the following resolution was

Resolved, that this Town Board does hereby accept the Special Lighting District Budget at $2,000, for the fiscal year 2008.

Reassessment

Supervisor Dixie Baldrey said that the Town Board Members have had many opportunities to discuss and talk about the pros and cons of doing a reassessment for the Town of Lexington , and would like a decision on what the next move would be.

Assessor Georgette Krauss submitted comparisons of proposal for the 2009 Town wide Update of the reassessment, and a discussion was held on the information submitted.

RESOLUTION #120-07

AUTHORIZE REASSESSMENT OF PROPERTY FOR 2009

On a motion from Supervisor Dixie Baldrey, seconded by Council Member Paul Van Valkenburgh, the following resolution was

I hereby recommend that the Town of Lexington Town Board do the revaluation of the assessment of property in the Town of Lexington for 2009. 

BAR Member

Supervisor Dixie Baldrey said that she will be contacting a Town of Lexington resident, Judith Chatfield, to see if she would be interested in becoming a BAR Member for the Town of Lexington .  

Culvert Cleaning Truck

Supt. of Highways, Larry Cross, said that the Town of Catskill has this truck that they would like to sell for $2,000.   It cleans culverts that are four inches and up, and it has many different size nozzles.   Further discussion was held. 

RESOLUTION #121-07

PURCHASE A CULVERT TRUCK / CATSKILL

On a motion from Council Member Paul Van Valkenburgh, seconded by Council Member Keith Mellott, the following resolution was

This Town Board of the Town of Lexington approves the expense of up to $2,000. towards the purchase of the culvert cleaning truck from the Town of Catskill .

Lexington House

Supervisor Baldrey asked the Town Board Members if they had any objection to her contacting CWC regarding the Lexington House, to see if the Catskill Watershed Corp. would be interested in renovating the building and reselling it to a private concern.  Carolyn Bennett said that she has had conversations with the CWC because she felt that the Lexington House has historical value and wanted to see if anything could be done with it.  A discussion was held and the Town Board members had no objection with the Supervisor contacting CWC..

Second Tax Notice Fee

RESOLUTION #122-07

AUTHORIZE  FEE  FOR  SECOND  NOTICE

On a motion from Council Member Paul Van Valkenburgh, seconded by Council Member Keith Mellott, the following resolution was

ADOPTED    Ayes 5 -- Baldrey, Byrne, Nelson, Mellott, Van Valkenburgh

                    Nays 0

            WHEREAS, The Town of Lexington is required to send out unpaid tax notices to taxpayer who have not paid their taxes for the current year, and;

            WHEREAS, The Town of Lexington can impose a fee of $2.00 to be added to their unpaid taxes to cover cost of the mailing under Real Property Tax Law § 987,

            THEREFORE, This Town Board resolves to change and impose a $2.00 fee, which cannot be waived and becomes part of the total amount due when sending out the second tax notice.

Aflac

Supervisor Dixie Baldrey said that a gentleman from Aflac has been calling her and wanted to give out information to the town employees.  She will gather the information and give it out for personal use --- to see if anyone is interested in what they have to offer.

Annual Paychecks

The annual paychecks will be mail out and  should be received by December 7 th , 2007.

RESOLUTION #123-07

INTER-MUNICIPAL HIGHWAY DEPARTMENT AGREEMENT

On a motion from Council Member Keith Mellott, seconded by Council Member Paul Van Valkenburgh, the following resolution was

It is resolved, that this Town Board shall enter into the Inter-Municipal Highway Agreement as stated in the agreement.

Inter-Municipal Highway Department Agreement

            As agreed by the Supervisor, Town of Ashland, Lexington, Windham, Hunter, Prattsville, Jewett, Halcott and the Village Mayors of Tannersville and Hunter at the November 26 th , 2007  meeting of the Mountaintop Town Supervisors and Village Mayors Association.

            The agreement this  8 th day of November , 2007, among the Town of Ashland, Town of Lexington, Town of Windham, Town of Hunter, Town of Prattsville, Town of Jewett, Town of Halcott, Village of Tannersville, and Village of Hunter (“the participating Municipalities”) in accordance with Section 119-0 of the General Municipal Law.

            WHEREAS, each participating Municipality maintains its own highway department, including personnel and equipment, for the maintenance of its roads; and

WHEREAS , from time to time the Highway Department of one or more or more of participating Municipalities requires additional equipment and/or personnel to complete a highway project; and

WHEREAS, THE PARTICIPATING Municipalities recognize that by cooperating in the sharing of equipment and/or personnel they can realize substantial savings in labor and equipment cost,

            IT IS HEREBY AGREED AS FOLLOWS:

1.   Each participating Municipality may assist any other participating Municipality by                           providing available labor and/or equipment when required by one of the participating                      Municipality highway project.

2. Each participating Municipality will be responsible for all salary and benefits associated with its employees and cost of its equipment when used in a highway project of another participating Municipality.

3. Nothing in this Agreement alters the employment relationship between a participating Municipality and its employee.  However, any employee employed by a participating Municipality pursuant to  this Agreement shall be considered to be a shared or co-employee of the receiving Municipality.

4. This agreement shall run from April 2008 to April 2009 unless renewal shall expire.

NOTCH VIEW ROAD

             This Town of Lexington Town Board approves the naming of the following road as stated below;

            Whereas, the owner, Anthony Di Benedetto,  has requested the name of “Notch View Road” for his private road, which has access to Parcel #109.00-2-95, Parcel #109.00-2-96, and Parcel #109.00-2-97, which  is located off of County Route 23C on North Lexington.

Public Concerns

 

Cell Tower

Glenn Howard updated the Town Board Members on the progress of their snowmobile club that they organized as a group.

Glenn Howard asked how the Cell Tower is coming along --- he had a concern because of a right-of-way to the site and thought that it would be great to have the fire radio from the same site.   A discussion was held and Supervisor Dixie Baldrey said that they are coming back to check out the site for the cell tower on November 20 th .  

Wednesday, November 28 th – Glenn Howard asked to use the Town Board Room for a meeting of the snowmobile club and the Board Members agreed that it wouldn't be a problem.   

Thank You Notes

The Town of Lexington received thank you notes from the Sprouts Program and the Kyle Leach Memorial Fund.

Youth Fair

The Town of Lexington also received a letter from the Greene County Youth Fair asking for a donation towards fire works for next year.  A discussion was held and the Town Board Members did not want to donate towards fire works.
