Board Meeting-Public Hearing for the Preliminary Budget

A Public Hearing for the Preliminary Budget of 2011 of the Town Board of the Town of Lexington, County of Greene and State of New York was held at the Kenneth a. Becker Municipal Building, 3542 Route 42, Lexington, NY on the 4th day of November, at 6:30 p.m.

The notice for the Preliminary Budget Hearing was published in the Windham Journal the week of October 21, 2010, and copies of the 2009 Preliminary Budget were available for the public.
Supervisor Greg Cross opened the Public Hearing for the 2011 Preliminary Budget by the Town of Lexington Town Board, and asked the public if they had a comments or questions on the 2011 Budget for the Town of Lexington.
Public Hearing – 6:30 pm
Dixie Baldrey asked about a figure on Page 9 –under Cemeteries, Contractual, where – she stated that there was always a five hundred dollar amount in the contractual for repairs for work in all the little cemeteries in the area. Supervisor Cross answered that there was five hundred in A8810.1 for personnel Services – that would be for Rose Ann & George. Dixie Baldrey said that it was put in the reserve fund for repairs at the cemeteries, like stone walls and etc. --- Supervisor Cross agreed that it was not in there and that it wasn’t in the 2010 budget either. A discussion was held about the five hundred dollars that was in the 2009 budget but not in the 2010 budget.
Dixie Baldrey said her next question was that under the Highway Appropriations – she did not see any reduction in personnel. Supervisor Greg Cross said they did not take any money out of the Highway Budget due to the reduction of the workforce because there are a couple of culvert pipes that are going to be of significant cost to the town and next year might be the best year and the proper time to do it.
Dixie Baldrey asked if the figures in the 2011 budget under personnel and benefits are still based on four people. Supervisor Greg Cross answered and said, yes, that was correct and the retirement is based on a projection by the state, which is provided to the Supervisor.
Joyce Rood said that she had a question, She stated that she thought that the raises given this year --- at this time – was not the time to give out raises. Most of the taxes are paid by senior citizen on Social Security and it has not gone up in the past few years. Supervisor Cross said that to answer that question – this past January, the new Town Board did hold and froze the pays for the 2009 salaries – the only person in 2009 that did get a pay raise was the Town Clerk. Supervisor Cross went on to say that his Tentative Budget provided some positions to get pay raises – and in the budget workshop – some members of the Board chose to give pay raises higher than what he had proposed and that was in the Preliminary Budget.
Councilmember Keith Mellott said that the Preliminary Budget right now is the same as last year, so there was no tax increase on them that they knew of. He went on to say that the budget has been kept the same as last year.
Councilmember Lynn Byrne said, yes, except personnel services for the building. That went from 11.40 to 12.50 an hour.
Judy Visich asked why the pay for Rose Williams on the Planning Board was reduced so much. It doesn’t seem like anybody else across the board took a cut like that - except for Rosie, which is quite substantial. Supervisor Greg Cross said that he was a member of the Planning Board, and his position on that pay decrease was that if you look at the hours and divide it into the total of $6,000. – that salary ……
Judy Visich asked how many hours you would say she works over the course of a year. Supervisor Greg Cross said that Glenn Howard, being a chairman of the Planning Board last year – at the budget workshop - stated that she works between six (6) and seven (7) hours per month. More discussion was held on the reduction of the salary for the Planning Board Secretary. If you would like to hear the whole discussion – stop by my office and I will let you listen to the tape – I will keep it safe in case anyone would like to listen.
Councilmember Glenn Howard said that he had just jotted a few figures down on a paper and let us just say that Rosie does twelve meetings a month, and say they last two hours which they very seldom do – but just for arguments sake --- they last two hours --- let us say she works six hours one day a week, on Tuesday – that is another three hundred and twelve hours (312 hrs.) so that would be 336 hours or to make it simple, three hundred hours (300 hours) a year and at six (6) thousand dollars – that would be thirty (30) dollars an hour. Judy Visich said that maybe someone should ask Rose how many hours she spends a week.
Rose Williams, as Planning Board Secretary, said that she has been asked that before and could not really put an hourly figure on that. During this week, she had somebody come in and they wanted to go over the map, and she asked him if he filled out an application, and he said, No, so, she replied to him by saying that she thought that they needed to do that and he sat down and proceeded to do that. She said he was in her office for about an hour and she helped him and they went back and forth with question and answers. It was Richard D’Angelo and Mary can verify that because she saw him in my office. I cannot put an hourly time that I spend with these people and what I do with these people because I can be out on the street and I get questions asked of me – do you do this or do that --- or what do I have to do with this Rosie. It is neither here nor there, but I do get to the point ---- I don’t care what you do and you can record that and put that in the newspaper if you want. This stuff is not worth the aggravation.
John Loftus asked about this budget or any other budget – he asked if there has been any effort into starting a separate fund for fixing up the garage or building a new garage --- not this year or next year, but like putting a sur-tax on the individual taxes which no one wants to hear; but no one wants to hear that the garage fell down around the trucks. He said that he was only throwing that out to think about and he would like the Board to consider it. Supervisor Greg Cross said that over the past couple of years – the previous Board obviously put in a little more than twenty thousand dollars into the roof and they are now waiting for two garage doors to be delivered to fix the two that are falling off the building. He believes as a builder -- that it would be more cost effective to fix what they have rather than replace it, and a few years ago – the cost of a new structure was looked into and it was leaning on a million dollars. That was the number that was floated around. More discussion was held on the town garage.
Taris Charysyn said there was nothing in the budget about demolition of unsafe buildings and wanted to know why because there are many unsafe buildings that are eye sores in the town. Supervisor Greg Cross said they are aware of the unsafe buildings, and there has never been any money in that line item of the budget. More discussion was held. Councilmember John Berger read from a notice which all the Town Board Members received regarding an unsafe building on Spruceton Road, and he said that he had a list of all the unsafe buildings which the Code Enforcement Officer is now working on, but did not have it with him at that time.
JoEllen Schermerhorn asked about the figures in the Rescue Squad line of the budget. Supervisor Greg Cross said that he put the same numbers in for 2011 that was in the 2010 budget, so he and the board felt that they would put the same numbers in there, and the bill from the Town of Ashland would be taken from that. More discussion was held.
Judy Visich asked Supervisor Greg Cross if they were going to vote on the budget that night. Councilmember Lynn Byrne answered, no, and Supervisor Greg Cross said that he believed that they were. Judy Visich then went on to ask if a resolution was going to take place on the salary for the Planning Board that night. Supervisor Greg Cross said they would if the Town Board choose to do that.
Susan Constable said there has been a lot of talk that the Supervisor was not living in the town anymore, and if you as Supervisor have to vote on something ----- there might be legality on voting on something -- don't you have to live in the town that you are Supervisor from. Supervisor Greg Cross said that he is currently the Supervisor of the Town of Lexington, and if there are a handful of people who choose to question his residency -- there is a procedure they can follow --- if that procedure is followed and I am found not to be the Supervisor --- then at that point, my signature will not be or my vote will not count. As he was speaking to them at that time, he said he was going to vote on a town budget and he believed it was in the best interest of the people of the Town of Lexington. And that it was a budget that had no spending increases, and if you look at the newspaper --- every town around is looking at double digit increases. The people of this town have to be very proud of this town board and what has been done. He knows there have been disagreements on spending cuts, but if the board was talking about a 20% spending increase --- they would have the same people down here complaining. So, he said he was proud of the budget, and thought the Town Board should be commended for the budget put forth, and that was his position.
Elizabeth Hapeman asked how much the Greene Co. budget was going up and Supervisor Greg Cross answered that based on what he has read in the newspaper -- it would be a 2.2% increase -- that is only a recent figure from what he read in the paper.
Councilmember Lynn Byrne said that if you want to vote on the budget tonight, then she would recommend going line by line on the budget. There was a discussion on what budget this was that they were working on. Supervisor Greg Cross said the Preliminary Budget had been approved and Lynn -- you made the motion to approve it. Council Member Lynn Byrne said yes, she did. Supervisor Greg Cross then said the next move would be to adopt the 2011 Budget. Councilmember Byrne said, no, there is still time to ask question and change things that people have questions about. Supervisor Cross and Councilmember Berger said that was why we are here that night. Councilmember Byrne said that was why she would like to go line by line -- because she had questions. Supervisor Greg Cross then asked Council Member Lynn Byrne if her motion to approve the Preliminary Budget was incorrect. Council Member Lynn Byrne said that she approved the Preliminary Budget…… Supervisor Cross asked, now you have questions. Councilmember Lynn Byrne said that she has now had time to go through some of the financial paperwork, and yes, she did have questions, which she did not have time to do last time.
Supervisor Cross asked if there were anymore more comments or questions from the public.
Joyce Rood said that she had a copy of the town law and she did have anything against him either, but was speaking to Supervisor Greg Cross. Joyce Rood went on to say that she would like to read from town law; Ceasing to be a resident of the town. If, while holding a town office, the town officer moves out of the town and takes up residence elsewhere, the office becomes immediately vacant by virtue of such move. She went on to say that she knew and everybody else knows also that you do not live in the Town of Lexington and so, let’s be fair about it.
Supervisor Greg Cross asked if there were any other questions on the budget.
Judy Visich asked Supervisor Cross if he has been in touch with any legal representation to find out if while he was signing things -- if they were legal if he did not live in town.
Supervisor Greg Cross answered, No, I am the Supervisor for the Town of Lexington, but I have spoken to an attorney. More discussion was held.
Supervisor Cross said that he would like to close the public hearing on the 2011 Budget. Time: 7:10 pm

The Regular Meeting of the Town Board of the Town of Lexington was called to order on November 4th, 2010 at 6:00 pm by Supervisor Greg Cross to discuss whether the town should consider a revaluation this coming year. The pledge of allegiance to the American flag was done.

Supervisor Greg Cross said the Town Board Members asked Assessor Georgette Krauss to come in to give the pros and cons for having a revaluation for the Town of Lexington. Assessor Georgette Krauss gave her presentation to the Town Board Members and the public. She answered questions were asked.
Assessor Krauss said that they need to hear from the community, to hear what their concerns are and address their concerns as best one can; and then make a decision from there on what should be done. More discussion was held.
Amend Resolution
Supervisor Greg Cross called for a resolution to amend “Resolution #138-10” which would reflect the correct amount in the Preliminary General Fund Budget for 2011 because it was added up wrong at the time.

This Town Board moves to amend Resolution #138-10 to read; “Resolved that this Town Board does hereby accept the Preliminary General Fund Budget for fiscal year 2011 at $450,248. less Estimated Revenues of $44,150., less Unexpended Balance of $40,000. for a total of $366,098. to be raised by taxes.
At 6:30 pm – Supervisor Greg Cross recessed from this meeting to go to Preliminary Budget Hearing for 2011 Budget, which was advertised in the Windham Journal for that time.

Supervisor Greg Cross asked the Town Board Members if they wished to make any changes.
Councilmember Lynn Byrne asked if they were going through it line by line.
Supervisor Greg Cross said they would not, unless the entire board feels we need to.
Councilmember John Berger said that he did not think it was necessary.
Councilmember Keith Mellott said they had gone through it line by line already.
Councilmember Glenn Howard said there were only a couple of minor changes and they went through the whole thing already and there were only a couple of minor changes.
Supervisor Greg Cross asked the Town Board Members; as far as the planning board secretary -- how does the Town Board members feel?
Councilmember John Berger wanted the salary to stay where it was.
Councilmember Lynn Byrne wanted the salary to go back to 2010.
Councilmember Keith Mellott asked Councilman Glenn Howard how he felt.
Councilmember Glenn Howard, said this one was a though one, and to tell you the truth, he liked Elaine's idea -- he thought that they could come half way and if that was done -- it would bring her back down to around thirteen dollars an hour or so. That would be $4,000 a year --- if she puts in 336 hours a year…..
Council Member Byrne said that you cannot do it hourly when someone is paid a salary.
Council Member Howard said that he I knew she was, but we are going by the approximate number of hours that Rosie puts in and he believed that the 336 hours a year was a pretty accurate figure of what she puts in -- she might put in an hour or two on Monday, an hour or two on Tuesday or Wednesday, but he believed it was a fair estimate of hours that Rosie puts in for the Planning Board.
Councilmember John Berger said that suppose in January ---- Rose decides she doesn't want to do the Planning Board Sec. anymore, and someone else walks in the door --- do you want to pay them the four thousand dollars.
Councilmember Glenn Howard responded, No - he did not think so.
Councilmember John Berger asked if you were applying the money to the job or to Rose as Planning Board Secretary. Further discussion was held.
Resolution # 142-10
Set Planning Board Salary - 2011
On a motion by Councilmember Keith Mellott, seconded by Councilmember Glenn Howard, the following resolution was

This Town Board moves to make the Planning Board Secretary - Salary -- Personnel Services (A8020.1) at $4,000. on the stipulation that Rose Williams stays on as Planning Board Secretary, and if she declines the position, the new appointed person’s salary will be back to a salary of $2,000.
Changes and Budget Discussions
On Page 9 of the Preliminary Budget: Item: Planning, Personnel Services will reflect Resolution #142-10 which was just adopted -- Line Item - A8010.1 will go from $2,000 to $4,000 in the adopted column of 2011 Budget.
Councilmember Lynn Byrne asked about line item A8160.4 -- saying there was $16,000. for Refuse and Garbage. She went on to say that up until now -- $12,000 dollars has been spent already on that this year and wondered if the board could cut back a little more on that. They agreed that it was alright the way it was.
Councilmember Lynn Byrne said that she would like some clarification after looking through the budget. She asked about the Financial Report from her mail box, and on Page 1, after looking at the budget Line A1220.11, it says Bookkeeper in the financial report and Personnel Services in the Budget. Supervisor Cross said that the Bookkeeper and the Assistant to the Supervisor have separate line items in the budget.(Same account number, but different lines)
Councilmember Lynn Byrne went to Page 3 and asked if there were any grievances against the town. Supervisor Greg Cross said that he did not discuss or answer that in an open meeting.

Councilmember Lynn Byrne asked if any money should be added to the Dog Control, Contractual (A3510.4) line item for doing the dog licenses this year. Town Clerk, Rose Williams answered that some amount should be added for the supplies and the expense of licensing the dogs. Supervisor Greg Cross suggested putting $500. additional to cover the cost, and it was agreed upon. (Line item - A3510.4 will have to be increased by $500. for dog licensing supplies.)
Councilmember Lynn Byrne asked about Page 7, after looking at financial statements -- Line A5132.4 (Garage) -- the financial statement says the contractual used for this has already been $9,269., and the budget is calling for $8,000. Supervisor Cross said that money reflected the new tanks which were bought at the highway garage, and the removal of the old tank. That is why it is over budget this year, and the Board Members agreed that it was alright the way it was.
Supervisor Cross asked Councilmember Lynn Byrne if there was anything more and she answered there wasn't.
Councilmember Glenn Howard asked Supervisor Greg Cross if he had money in the budget to remove the tank behind the Municipal Building and Supervisor Greg Cross said there was funding to do that.

This Town Board approves the Financial Report through September 2010, which was presented by the Supervisor.
Oil Tanks
Supervisor Greg Cross said that the new fuel oil tanks are in the basement and the Town Board is soliciting bids to remove the old tanks. If does not get done this year, NYS Dec will allow for it to carry over until next year.
Tank removal estimates received were:

Emergency Medical Services
Supervisor Greg Cross reported for information purposes that the cost to the town this year would be $3,523.00 for the emergency medical services. This helps pay for the fly car and other emergencies services through Greene County.
Dog Law Fees
Supervisor Greg Cross said they needed to set fees for the cost of dog license which will be implemented on January 1, 2011—when the town does the licensing of dogs instead of NYS Dept. of Agriculture & Markets.
The Town Board Members discussed what the dog fees should be for the licensing of dogs in the Town of Lexington.

The Town Board set the Public Hearing for Local Law # 2 of 2010 “Regulating the Licensing of Dogs” for December 7, 2010 at 6:30 p.m. It will be advertised in the local newspaper.
Furnace
Supervisor Cross reported that the furnace is leaking from the inside --- there might be a need for new gaskets or whatever. The Town Board decided to contact the company that installed the furnace to see if they could fix the problem with the leak. The name of the company was Polsinello Fuels, Inc., 41 Riverside Abe. Rensselaer, NY 12144 (518-465-3535 or 4653-0084)
Garage Doors
Garage Doors will be installed between November 15th to the 19th.
Smoke Alarm System
Councilmember John Berger reported the Smoke Alarm System would be done within the next week.
Cell Tower
Councilmember Glenn Howard said that he tried to call the guy regarding the cell tower on the private property and was unable to get through to him. So there is no further news.
Lights in Front need Repair

This Town Board authorizes Supervisor Greg Cross to contact Robert Basil to fix the lights on the front lawn which need repair from the flood of October 1st.
Public Concerns
Someone asked about the red lights still being at the bridge, and Frank Hermance, Supt. of Highways, said there is structural damage to the bridge and it would take at least four weeks to do the welding. A red light would also be put up by Lady Bridge because they need to repair the bank where it was washed away during the flood.
Elaine Fekner said that she has noticed that the posts for the town signs are in need of painting and the Board will look into that in the spring of the year.
Truck Parts / Roxbury
Supt. of Highways, Frank Hermance, said the Town of Roxbury called and would like to buy the steering cylinder of a truck. A discussion was held on the price of the cylinder.

On a motion by Council Member Keith Mellott, seconded by Council Member Glenn Howard, the following resolution was
ADOPTED - Ayes - 5 - Cross, Byrne, Howard, Mellott, & Berger

The Town Board agreed and authorized the Supt. of Highways, Frank Hermance, to surplus the steering cylinder for the Oshkosh for no less than $2,200. with a hopeful price of $2,500.
Public Concerns – Continued
Jo Ellen Schermerhorn said that the fire signs are still needed and she felt that it was really important to get them up in case of an emergency.
Jo Ellen Schermerhorn asked what was happening with the EMS for the West Kill side from the Shandaken Rescue Squad. Supervisor Greg Cross said that he has not gotten that done – he hasn’t made contact with Rob Stanley from Shandaken, but Councilmember Howard has contacted him, and Supervisor Cross will contact him soon.
Council Member Lynn Byrne said that at that time, which was based on her own beliefs and her own conscience ----- that she would like to request that Supervisor Greg Cross resign because they had no proof of his residency and she also said that she was a little surprised that the Board Members had not wanted to support this position. She feels that she has waited many months to find out about the residency, and she hadn’t gotten anything from Supervisor Greg Cross. Now, it is being asked to be proven by the Board of Elections, and she was hoping that she didn’t have to go that route, and was hoping in her opinion, for him to do the right thing and resign.
Supervisor Greg Cross asked for a motion to pay the bills.

Resolved, that this Town Board, having audited the following General Fund Vouchers
# 266 through #293, inclusive, hereby, orders them paid and directs the Town Clerk to draw Abstract #11, General Fund, on the Supervisor for payment of $ 8,384.79
Resolved, that this Town Board, having audited the following Highway Fund Vouchers
#172 through #194, inclusive, hereby, orders them paid and directs the Town Clerk to draw Abstract #11 Highway Fund, on the Supervisor for payment of $ 21,157.40
