Board Meeting

Town of Lexington Planning Board
October 14, 2008

Chairman Glenn Howard called the regular monthly meeting to order on October14, 2008 at the Lexington Municipal Building, 3542 Route 42, followed by the pledge of allegiance to the American Flag.  

Planning Board Members present were Chairman Glenn Howard, Ralph Albino, Susan Constable, Robert Hermance, Edwin Dippold, Jr.  Absent were Greg Cross and Taris Charysyn

Others present were Attorney Larry Gardner, Paul Van Valkenburgh and Rose Williams, Secretary.

Minutes

            Ralph Albino made a motion to accept the minutes of the meeting held on September 9th, 2008, seconded by Edwin Dippold, Jr.

Vote: Howard-aye, Hermance-aye, Constable-aye, Dippold-aye, Albino-aye, Carried.

          Absent were Cross & Charysyn

 

Dillport / Wells to NYCDEP Minor Subdivision – Parcel # 160.00-2-34 – Spruceton Rd.

                                                                            68.053 Acre Parcel – Dillport / Wells

                                                                                 328.373 Acre Parcel – NYC DEP

                                                                                 Final Approval                                         

            Chairman Glenn Howard said that Attorney Larry Gardner had contacted the surveyors to discussed the inconsistencies that were on the survey map of the Dillport / Wells Minor Subdivision.

The items that needed correcting were as follows:

  1. 1.      The survey line at the top of the mountain because it did not agree with the

       NYS DEC line to the pile of rocks painted yellow.

  1. 2.      The Deyoe Road & logging road was mislabeled.   

            Chairman Glenn Howard said that he had been assured by Attorney Larry Gardner that he had the inconsistencies resolved.  Next, the Planning Board Members reviewed the new maps that were presented by Attorney Larry Gardner, which showed the correction of the survey line and the correction of the names on the roads.

The file for the Dillport / Wells Minor Subdivision contained:

  1.      Application and filing fee of $100.00
  2.      $ 50.00 for each lot created (2)
  3.      Sketch Map
  4.      Completed Short EAF
  5.      Preliminary  Plan Maps – Survey
  6.      Minutes from 4/8/08, 9/9/08  
  7.      List of Land Adjoiners
  8.     Letters sent to Adjoining Land Owners (18)
  9.       Return Receipts from Mailings
  10.    Letter & Information regarding Parcel #160.00-2-34 from Attn. Larry Gardner                                                                                              

            Chairman Howard asked if there was any further discussion, and everyone was in agreement that the map was correct now, therefore, Chairman Glenn Howard called for a motion to give final approval to the Dillport / Wells Minor Subdivision.

Final Approval – Dillport / Wells Minor Subdivision

            Robert Hermance made a motion to grant Final Approval for the Dillport / Wells Minor Subdivision of Parcel #160.00-2-34, where it would be subdivided into Lot # 1 being 328.373 Acres and Lot # 2 being 68.053 Acres, seconded by Edwin Dippold, Jr.                   

Vote: Howard-aye, Hermance-aye, Constable-aye, Dippold-aye, Albino-aye, Carried.       

         Absent were Cross & Charysyn

             Chairman Glenn Howard signed the maps and mylar for the Dillport / Wells Minor Subdivision.  A bill was given to Attorney Larry Gardner for the charges incurred from this subdivision, which included the publication notice that was published in the Windham Journal, and the certified letters / return receipt fees, that were sent to eighteen adjoining land owners.  The total fee amounted was $109.82.

Correspondence

            Glenn Howard received a call from Michelle Yost to say that there was going to be a meeting in Windham about mapping --- the Mapping Department at Greene Co. Planning would like input from the towns to make maps – it was suggested that it would be nice to have a copy of the Town of Lexington maps with aerial views that shows the contour lines and etc. on them, and it would also be nice to have topographic maps for the town.

            Robert Hermance made a motion to adjourn the meeting, seconded by Ralph Albino. 

Everyone agreed.

            Chairman Glenn Howard adjourned the meeting at 7:44 PM.
