Town of Lexington Planning Board

October 13, 2009

Deputy Chairman Robert Hermance called the regular monthly meeting to order on October 13, 2009 at the Lexington Municipal Building, 3542 Route 42, followed by the pledge of allegiance to the American Flag.  

Planning Board Members present were Deputy Chairman Robert Hermance, Ralph Albino, Susan Constable, Greg Cross, Taris Charysyn, and Edwin Dippold, Jr.  Absent was Glenn Howard.

Others present were Jay Truesdell, James Boyle, and Rose Williams, Secretary.

Minutes

            Ralph Albino made a motion to accept the minutes of the meeting held on September 8, 2009, seconded by Edwin Dippold, Jr.

Truesdell Property – Airport Road – Parcel #109.00-2-83.2

      The appraiser for the property belonging to Jay Truesdell on Airport Road said that a variance was needed to grandfather the property in as a single family residence with an accessory apartment because it is now considered an in-law apartment.   The appraiser, Jon M. Wagoner, from Key Bank Mortgage, also said that he would need a rebuild letter stating if structure was 100% destroyed --- the same structure could be rebuilt and be in legal zoning and in compliance with the town Zoning Law. 

       The Planning Board members discussed the different apartments through out the town, and reviewed the Town of Lexington Zoning Law.  Planning Member, Ralph Albino referred to page 16 of the Zoning Law --- where under “§ 4.02 Use Table – It is designated a use permitted by right for a two family dwelling (in one building).”  More discussion was held. 

      Taris Charysyn made a motion to have the Code Enforcement Officer James Boyle write a
letter stating that the apartment in is compliance with the Zoning Law for the Town of Lexington
according to § 4.02 -- Use Table and the Use Category, seconded by Edwin Dippold, Jr.

Smith Minor Subdivision  -- Parcel # 128.00-1-17.1 – County Rt. 13
                                            Sketch Plan Approval
                                            20 +/- acres from 44+/- acres

          James Boyle, with permission from Augot Agnes Smith, is asking for sketch approval for a minor subdivision of parcel #128.00-1-17.1, where 20 +/- acres would be subdivided from the Smith’s  44 +/- acres,  which is located on County Rt. 13.   The completed application is on file along with the Letter of Agent / Power of Attorney. 

         Deputy Chairman, Robert Hermance told James Boyle that he would need to go to the Greene County Highways Department to get a permit for his driveway, which he said that he would do.   Planning Member Ralph Albino asked how much road frontage was there for the property and it was determined to be around 450 feet, which was adequate. 

         Larry Vanucchi Associates will do the survey for the said parcel and subdivide the twenty acres out.    Deputy Chairman Hermance said the survey maps should be brought to the next meeting for review to get preliminary plat approval, and then after the that meeting --- there would be a public hearing and final approval if everything was in order.   Things the Planning Board would like to see on the survey map are contour lines, any easements, and any right-of-ways for the property.
                                                           
       A discussion held on the fees and payment will be made at the time of the Preliminary Plat Approval. 

Sketch Plan Approval 

       Ralph Albino made a motion to give Sketch Plan Approval for the Minor Subdivision of Parcel #128.00-1-17.1 (Smith), where 20 +/- acres would be subdivided from the 44 acre parcel, seconded by Gregg Cross.  
    
 Vote: Hermance-aye, Constable-aye, Dippold-aye, Albino-aye, Cross-aye, Charysyn-aye, 
          Carried.    Absent: Howard  

            A discussion was held on whether or not a “239 Review” was needed from the Greene
County Planning Board because the property is located on a County Road   The Lexington
Planning Board will contact the Greene County Planning Department to get their
recommendation.   Secretary Rose Williams, contacted Ed Diamante at the Greene County
Planning Department to see when their next meeting would be held and to see what
needed to be done for the “239 Review”.   Mr. Diamante said they were not allowed to intervene
in any subdivision off a County Road.  The 239 Reviews which they review at the County level
was for zoning variances only.

            Taris Charysyn made a motion to adjourn the meeting, seconded by Edwin Dippold, Jr.  All
Agreed.

            Deputy Chairman Robert Hermance adjourned the meeting.
