TOWN OF LEXINGTON - ORGANIZATIONAL MEETING
The Organizational Meeting of the Town Board of the Town of Lexington was called to order on January 3, 2012 at 6:30 P.M., by Council Member John Berger at the Lexington Municipal Building because the new officials needed to be sworn in, and it was followed by the pledge of allegiance.
Judge Robert Basil was present at the Organizational Meeting to administer the Oaths of Office to the new
Town of Lexington Officials for the coming year of 2012.
Therefore, Judge Basil installed the following new officials:
Dixie Baldrey – Supervisor (Term: 1-1-12 to 12-31-14)
Jo Ellen Schermerhorn – Council Member (Term: 1-1-12 to 12-31-16)
William Pushman – Council Member (Term: 1-1-12 to 12-31-12)
Frank Hermance – Superintendent of Highways (Term: 1-1-12 to 12-31-14)

After the new officials had taken their Oaths of Office and were seated, Supervisor Dixie Baldrey said that the first order of business would be to appoint a Council Member to fill the vacancy on the Town Board because of the tie at the General Election held on November 8th, 2011. The tie vote at the time of election was between William Pushman and Lynn Byrne; both seeking the Council Member position. The resignation of Council Member Glenn Howard was filled by the appointment of William Pushman at the December 20, 2011 meeting, and there was still another vacancy for a Council Member. Therefore, Supervisor Baldrey asked the Town Board Members for an appointment.

APPOINT COUNCIL MEMBER TO FILL VACANCY
On a motion by Council Member John Berger, seconded by Council Member William Pushman, the following resolution was

This Town Board moves to appoint Lynn Byrne to fill the vacant Council Member seat for the Town of Lexington Town Board for the 2012 year.
Judge Basil gave the Oath of Office to Lynn Byrne as the new Council Member for the Town of Lexington Town Board after the appointment from Resolution # 1-12 with a term from 1-3-12 to 12-31-12

APPROVE MINUTES
On a motion by Council Member John Berger, seconded by Council Member JoEllen Schermerhorn, the following resolution was

This Town Board moves to approve the minutes of the Year-End Meeting held on December 27, 2011.

TOWN BOARD MONTHLY MEETING NIGHT
On a motion by Council Member Lynn Byrne, seconded by Council Member JoEllen Schermerhorn, the following resolution was
ADOPTED - Ayes - 5 – Baldrey, Berger, Pushman, Schermerhorn, Byrne.
Nays - 0
Resolved, that this Town Board designates the first Tuesday of each month at 6:30 pm to be the regular meeting night of the Town Board of the Town of Lexington, and the meetings will be held at the 3542 Route 42, Municipal Building, and keep the third Tuesday of the month in reserve.

CALLING SPECIAL MEETINGS
On a motion by Council Member Lynn Byrne, seconded by Council Member John Berger, the following resolution was

It is resolved, that Special Meetings may be called by the Supervisor, provided that 72 hours advance notice be given to Town Board Members, when practical, and that the Supervisor will call a Town Board meeting at the request of two or more Town Board Members.

DESIGNATION OF BANKS
On a motion by Council Member William Pushman, seconded by Council Member Lynn Byrne, the following resolution was
ADOPTED - Ayes - 5 – Baldrey, Berger, Pushman, Schermerhorn, Byrne.
Nays - 0
Resolved, that this Town Board does hereby designate The Bank of Greene County of Tannersville, NY, and the NBT Bank, NA., of Grand Gorge, NY, as the official depositories for the Town of Lexington funds for the year 2012.
It further resolves, that all funds guarantee a third part Collateral Agreement with the following institutions, which are The Bank of Greene County, Tannersville, NY, and NBT Bank, NA, custodian Bank of New York (BNY), Grand Gorge, NY.

INVESTMENT OF IDLE MONIES
On a motion by Council Member John Berger, seconded by Council Member Lynn Bryne, the following resolution was
ADOPTED - Ayes - 5 – Baldrey, Berger, Pushman, Schermerhorn, Byrne.
Nays - 0
Resolved, that this Town Board hereby authorizes the Town Supervisor to invest idle moneys to MMD’s, CD’s, Treasury Notes, Treasury Bills, and Treasury Bonds at the above banks, with records of account balances to be submitted to the Town Board monthly.

On a motion by Council Member JoEllen Schermerhorn, seconded by Council Member John Berger, the following resolution was

Resolved, that this Town Board does hereby designate the Windham Journal of Windham, NY, as the The Daily Mail at Catskill, NY as the Official Newspapers for the Town of Lexington advertising for the year 2012.

MILEAGE COMPENSATION & DINNERS FOR TOWN OFFICIALS
On a motion by Council Member William Pushman, seconded by Council Member John Berger, the following resolution was
ADOPTED - Ayes - 5 – Baldrey, Berger, Pushman, Schermerhorn, Byrne.
Nays - 0
Resolved, that this Town Board does hereby fix mileage compensation at $ .55½ per mile for the following: Assessor for property damage, etc.; Code Enforcement Officer, Constable, Dog Warden, Justices, Town Supt. of Highways, Town Clerk/Collector, Town Supervisor, Town Council Members, Planning Board Members, or any appointed or otherwise elected official that goes on official Town business.
Be it further resolved, that this Town Board authorizes payment of meals for Town Officials that attend official meetings, not to exceed $ 20.00 maximum for a dinner and a $ 40.00 maximum per day.

Association, NYS Supt. of Highways, Assoc., NYS
Assessors Association, Greene County Assessors Association, Mountain Top Supervisor’s and Mayor’s Assoc., Columbia-Greene Town Clerk’s Assoc. and the NYS Town Clerk Association.

PAYMENT OF BILLS IN ADVANCE OF BOARD MEETING
On a motion by Council Member Lynn Byrne seconded by Council Member John Berger, the following resolution was

Resolved, that this Town Board authorizes the Supervisor to pay certain claims of indebtedness in advance of Town Board meetings, i.e., electric bills, postage, fuel oil bill, gasoline bill, telephone bill, Key Bank Credit Card, Health Insurance, NYS Retirement Account, which will be followed up with an invoice on the abstract.

AUTHORIZE SUPERVISOR'S REPORT TO STATE COMPTROLLER
On a motion by Council Member JoEllen Schermerhorn, seconded by Council Member John Berger, the following resolution was

Resolved, that this Town Board authorizes the Supervisor to use the annual Supervisor’s Financial Report to the State Comptroller for the Annual Financial Report to the Town Board to be filed in the Town Clerk’s Office, where it will be available to all interested persons and to publish an abbreviated form of the report for the 2011 year in the Windham Journal by the end of February.
PLANNING BOARD MEMBER RE-APPOINTMENT
Supervisor Dixie Baldrey said that the term of Beverly Dezan expired on 12/31/2011 as a member of the Town of Lexington Planning Board. The appointment will be a seven (7) year term and will expire on 12/31/2018.

Resolved, that this Town Board shall re-appoint Beverly Dezan as a Planning Board Member with a term which will begin on 1/1/2012 and expires on 12/31/2018
Resignation
Supervisor Baldrey read a letter from William Pushman saying that he was resigning as a member of the Town of Lexington Planning Board because of his appointment as Council Member for the Town of Lexington Town Board, which was effective immediately -- letter dated 12-27-2011.

ACCEPT RESIGNATION / PLANNING BOARD MEMBER
On a motion by Council Member John Berger, seconded by Council Member JoEllen Schermerhorn, the following resolution was

Resolved, that this Town Board shall accept the resignation of William Pushman as a Planning Board Member.
Tabled the new Planning Board Member appointment and will ask the Planning Board for their recommendation.
ZONING BOARD OF APPEALS APPOINTMENT
The membership of Steven Soszynski expired on 12/31/11 as a member of the Zoning Board of Appeals.

Salaries
Supervisor Dixie Baldrey said the previous Town Board in preparing the 2012 Budget did not make any increases in salaries, so she would run through them, but went on to say that the previous Town Board granted an increase for the Town Clerk and Supt. of Highways in light of the additional work that was required of them because of the storm. The Board approved that -- the $1,000. as a pay raise, and Supervisor Dixie Baldrey recommended changing the pay raise as a stipend, and give the one-thousand dollars as a onetime stipend since the intent was to compensate for the additional work. Supervisor Baldrey asked for any discussion from the Board.
Council Member John Berger said that he did not attend that meeting regarding the stipends' and would like to discuss them further. Council Member Berger said that he believed that it sets a dangerous precedent -- to offer a stipend for a salary position --- a salary position is that you get so much money for doing this job whether you work at it for two
hours or thirty-five hours -- you get the same amount of money. Council Member Berger said that they should work with the salary they are offered.
Council Member William Pushman said that John and Lynn worked hard also and they did extra duties.
Supervisor Dixie Baldrey asked for a motion one way or the other.

Tabled Town Attorney
Special Meeting -- Supervisor Dixie Baldrey said that she would like to have a special meeting next week. Attorney Kevin Young called and needs to have a meeting to talk to the Town Board Members about the sewage district, and asked if the Town Board Members could meet next Wednesday, January 11th, 2012 at 7:00 pm.
Audit the Bills
William Pushman made a motion to audit the bills at the next meeting of January 11, 2012, seconded by Council Member John Berger. which was agreed upon and carried with the other Council Members.
Chargeback's
The Town of Lexington was charge$1,800. for Election Chargeback's for the 2011 year, which the town has to pay.
Public Concerns
Nick Palermo said that he did not feel that the Zoning Board of Appeals gets the credit they deserve in the job that they do --- Supervisor Baldrey gave him and the ZBA Members a round of applause and commend them for their work.
Robert Basil said that the Municipal Building is not acceptable as a rescue site because there is no generator along with other problems. He felt that when the committee meets, maybe they should have a public hearing, and put the input in from many people. Further discussion was held.
Judge Robert Basil also said that he would like to have a Deputy Court Clerk in place in case he ever needs to have one fill in. He explained what he would like and what would have to be done because the computer system for the court is getting very complicated and it would be nice to have someone step in case of an emergency. He went on to say that one might never need the person, but it would be great to have that in place. Supervisor Baldrey told Judge Basil to coordinate what he would like to do and get back to the Town Board on the details to implement.
