Town of Lexington Planning Board

January 8, 2008

            Chairman, Glenn Howard called the regular monthly meeting of the Town of Lexington Planning Board to order on January 8, 2008 at the Lexington Municipal Building, Route 42, followed by the pledge of allegiance to the American Flag.

            Planning Board Members present were Chairman Glenn Howard, Deputy Chairman Robert Hermance, Susan Constable, Edwin Dippold, Jr., Taris Charysyn, and Ralph Albino.   Absent was Robert Cross, Jr. because he sent a resignation letter to the Town Board affective December 31, 2007.

            Others present were Greg Cross, Land Surveyor – Joseph Vanucchi, Tom Lauritsen, Neil Warringer, Rose Williams, Secretary. 

Minutes

            Susan Constable made a motion to accept the minutes of the regular meeting held on December 11, 2007 after correcting a motion regarding the accepting of the Preliminary Plat Approval which was seconded by Edwin Dippold, Jr., and not Ralph Albino as stated, seconded by Edwin Dippold, Jr.

Summit

            Chairman Howard reminder the members of the Watershed Summit that will be held for 2008 on Saturday, January 19, 2008, with a snow date of January 26, 2008.  The summit will be held at the Hunter Elementary School on NYS Route 23A in the Village of Hunter, and starts at 9:00 PM until 2:15 PM.  Chairman Howard encouraged everyone to attend because it can be used towards the training that is needed by the Planning Board Members.

Registration

            A letter of resignation was read from Robert Cross, Jr. that was sent to the Town of Lexington Supervisor Dixie Baldrey where he resigned as a member of the Town of Lexington Planning Board, which was effective on 12/31/08.

Cross, Greg & Janice -- Minor Subdivision – Parcel # 109.00-2-86
                                                                                                Lot A = 2.935 Acres
                                                                                                Lot B = 5.179 Acres

            Greg Cross lives on North Lexington on County Route 23C where he has 8.114 acres, which he would like to subdivide into two parcels.   Greg Cross explained to the Planning Board Members how he would like to do the subdivision ---- he would like to split it up where there is a stone wall line, which makes Lot A under the required three acre parcel that is required in rural residential zoning.  Lot A has a house on it and Lot B is vacant land.  Greg Cross also said that there will be a fifty-five feet right of way along the side of Lot A to get to Lot B.  Greg Cross asked the Planning Board Members if the sketch plan had all the information that would be required because the surveyor would be going on vacation soon.  Chairman Howard said that contour lines should be put on the map.   Chairman Howard asked about the location of the septic and well, and Mr. Cross said that they were in line with the required regulations. 

            Ray Albino made a motion to refer Greg and Janice Cross to the Zoning Board for a variance because Lot A is under the 3 acres required in rural residential zoning, seconded by Edwin Dippold, Jr.

Close the Regular Meeting &  Go to Public Hearing

            Chairman Howard said that a public hearing was scheduled for 7:45 pm for the Bogart / Skrzypek Minor Subdivision.

            Taris Charysyn made a motion to recess the regular meeting and go to the public hearing that was scheduled for 7:45 pm for Bogart/Skrzypek Minor Subdivision, seconded by Edwin Dippold, Jr.

            The Public Hearing was opened at 7:50 PM by Chairman Glenn Howard.

Public Hearing – Bogart / Skrzypek Minor Subdivision –   Parcel # 110.00-1-32

            Chairman Howard asked the public if there were any comments or questions. 

            An adjoining land owner, Tom Lauritsen, asked if the owners were present and the answer was no, but Joe Vanucchi, the land surveyor, was present and would try to answer any of the questions along with the Planning Board.  
            Land Surveyor, Joe Vanucchi opened up the Survey Map and explained the subdivision and how it was being done to the land adjoiners, Tom Lauritsen and Neil Warringer because they asked how it was being done.   He also said that they were keeping one lot and selling the other lot.   
            Tom Lauritsen asked what the acreage size is now in Lexington, because he said that it was 2 acres.  The Planning Board Chairman answered that it is now 3 acres for the lot size in rural residential zoning. 
            Tom Lauritsen asked if perk test had been done on the property, and the land surveyor answered that they were done, but he didn’t have the results.   Chairman Howard said that the Planning Board did not have to be concerned with the perk test to grant a subdivision.
            Tom Lauritsen asked if the property can be used for any commercial use, and Chairman Glenn Howard said that it is zoned rural residential and if they wanted to do that ---- they would have to get a special use permit.
            Tom Lauritsen asked if the lots can be subdivided again, and the answer was that they could be done one more time, and the Planning Board would have to do that, and there is a five year limitation on subdividing again. 
            Tom Lauritsen asked if there was anything more that the neighbors should be made aware of and the Planning Board Members didn’t think there was anything and said that the letters were sent to the adjoiners, so that they are aware of the subdivision.

            Chairman Glenn Howard asked if there were anymore questions or comments’ regarding the minor subdivision before the Planning Board, and no response was made, so then Chairman asked for a motion to close the public hearing.

Close the Public Hearing

            Edwin Dippold Jr. made a motion to close the Public Hearing and return to the Regular Meeting of the Town of Lexington Planning Board, seconded by Ralph Albino.

            The Planning Board Members reviewed the file and said that the still needed a completed Short EAF Form.   Everything was complete in the file, which consisted of

                        Authorization letter for representation
                        Minutes of 10/9/07 & 11/13/2007 & 12/11/2007
                        Map with the poles designated on it.

                        Letters sent to the Adjoining Land Owners
                        Certified Mail Receipts back from Mailings
                        Public Hearing Notice sent to the local newspaper

 

 

Final Approval

            Taris Charysyn made a motion to grant Final Approval Bogart / Skrzypek Minor Subdivision – Parcel # 110.00-1-32, where Lot # 1 will be 11.494 Acres, and Lot # 2 will be 12.707 Acres, seconded by Ralph Albino.

           Howard-aye --- Carried.   Absent: Cross. 

            Chairman Howard signed the maps and mylar for the Bogart / Skrzypek Minor Subdivision, and the maps need to be file at Greene County.

Send Bill

            Secretary, Rose Williams, will send the bill to t he surveyor for the certified return receipt letters sent to the adjoining owner, the publication put in the local newspaper, the subdivision fee for the two parcels, and the recreation fee for each parcel.  The total amount due was $152.35, and a letter has been sent to Vanucchi Associates, %Larry Vanucchi.

Filing of the maps in Greene County

            Chairman Howard said that he would like to find a way that the Planning Board could follow up on the maps being filed in Catskill.  He suggested leaving the subdivision on the agenda until the Planning Board receives confirmation in some way that they have been filed with Greene County.  Further discussion was held. 

            Rose Williams, Secretary, said that she would ask the Town of Lexington Assessor, Georgette Krauss, if she could furnish the Planning Board with a copy of the paper work that she receives from Greene County when she is notified to change the lots on the tax map.

            Chairman Howard said that he would like a Minor Subdivision left on the agenda somehow, just as a check list ----- until notification that the map(s) have been filed ------ because he feels that the Planning Board is never sure if the maps are getting filed.  It happened two or three months ago, when the maps had not been filed; and the applicants had to back tract and get new maps and signatures in order to file them. 

Adjourn

            Taris Charysyn made a motion to adjourn the meeting, seconded by Robert Hermance.  Everyone agreed.

            Chairman Glenn Howard adjourned the meeting.
