Board Meeting 1/03/2007


The Organizational Meeting of the Town Board of the Town of Lexington was called to order on January 3, 2007 at 7:30 P.M., by Supervisor Dixie Baldrey at the Lexington Municipal Building, followed by the pledge of allegiance.
A moment of silence was observed in memory of Marguerite Thompson, Ihor, Sonevytsky, and Normand Auger.

Judge Robert Basil administered the Oath of Office to Keith Mellott as the new Council Member for the Town of Lexington, who will serve a term from 1/1/2007 to 12/31/2007

Public Concerns

Glenn Howard said that they formed their snowmobile club officially with around twenty members. They are proceeding with the next steps that they have to do now and one thing that they need, is a sponsor. They are asking the town to sponsor there club, so they can get the state funding that would be available to them. A discussion was held. Glenn Howard was asked what the responsibility was of the sponsor, and he said that there would be no liability to the town whatsoever --- the town would have to sign the trail application every year, and if the money gets approved, the check would be made out to the town and then the town would turn it over to the club. If there is any state land that the trails cross, then the town would have to sign the application for that. The club would also have to secure maps to use.
More discussion was held on where the trails are going to be and who is going to over see the trails (inspectors would over see them). The state has certified inspectors. The club purchases the signs and installs the signs. Ray Albino said that they would not use town roads, unless they have to cross a town road, which is allowed now. They will need to get permission from NYC DEP, NYS DEC, and private land owners for their trails and the snowmobilers have to stay on the trails. The name of their new Snowmobile Club is, “Big Valley Trail Breakers Snowmobile Club”

DESIGNATION OF BANKS

On a motion by Council Member Lynn Byrne, seconded by Council Member Maurice Nelson, the following resolution was

Resolved, that this Town Board does hereby designate the Key Bank of Windham, Windham, NY and Key Bank of Tannersville, Tannersville, NY and the NBT Bank, NA., of Grand Gorge, NY, as the official depositories for the Town of Lexington funds for the year 2007,

It further resolves, that all funds guarantee a third part Collateral Agreement with the following institutions, which are Key Bank, custodian Key Trust, Cleveland, Ohio, and NBT Bank, NA, custodian Bank of New York (BNY)

INVESTMENT OF IDLE MONIES

On a motion by Council Member Keith Mellott, seconded by Council Member Lynn Byrne, the following resolution was

Resolved, that this Town Board hereby authorizes the Town Supervisor to invest idle moneys to MMD’s, CD’s, Treasury Notes, Treasury Bills, and Treasury Bonds at the above banks, with records of account balances to be submitted to the Town Board monthly.

MILEAGE COMPENSATION & DINNERS FOR TOWN OFFICIALS

On a motion by Council Member Lynn Byrne, seconded by Council Member Keith Mellott, the following resolution was
ADOPTED - Ayes - 4 - Baldrey, Byrne, Nelson, Mellott.

Resolved, that this Town Board does hereby fix mileage compensation at $ .45 per mile for the following: Assessor for property damage, etc.; Code Enforcement Officer, Constable, Dog Warden, Justices, Town Supt. of Highways, Election Inspectors, Town Clerk/Collector, Town Supervisor, Town Council Members, Planning Board Members, or any appointed or otherwise elected official that goes on official Town business.

Be it further resolved, that this Town Board authorizes payment of meals for Town Officials that attend official meetings, not to exceed $ 18.00 maximum for a dinner and a
$ 35.00 maximum per day.

This Town Board approves the following Benefit Policy:

TOWN OF LEXINGTON BENEFIT POLICY

Elected officials are eligible for all benefits, as determined by the Town Board.

SICK BENEFITS
Sick time benefits shall be accrued at 8 days each year (for all full-time elected officials). Any employee taking sick time after two (2) consecutive days will be required to have a doctor’s certification before benefits are paid. Sick time may be accrued from year to year. Maximum benefit will be 165 days, and sick days cannot be used for vacation days. Upon retirement, any unused sick days can be used as additional service credit.

VACATION BENEFITS
All full time elected Officials employed by the Town for one year shall be eligible for 2 weeks vacation, and an additional 1 day added for each year thereafter --- up to 4 weeks, which is the maximum vacation benefit that any person can receive. Department Head approval is necessary before any vacation time is granted. Upon leaving Town service, employee will be compensated for unused vacation time

HEALTH INSURANCE BENEFITS
All elected and appointed officials working full time may receive 100% paid health insurance at the discretion of the Town Board. The Town Board must approve this benefit. Part-time employees, elected or appointed officials are not eligible for this benefit unless approved by the Town Board. The part time employee, elected, or appointed official, will pay a portion of the monthly premium. The Town Board will approve this amount.

PAID HOLIDAYS
Paid holiday benefits are to permanent full time employees, elected and
appointed officials working full time. Paid holidays are:

1. New Years Day 7. Columbus Day
2. Martin Luther King Day 8. Election Day
3. Presidents Day 9. Veterans Day
4. Memorial Day 10. Thanksgiving Day
5. July 4th 11. Christmas Day
6. Labor Day

PERSONAL TIME BENEFIT
Two days each year shall be granted for personal use to all full times permanent employees, elected and appointed full time officials. This benefit cannot be accumulated and if not used in the fiscal year shall not be carried over to the following year. No financial compensation for unused personal time benefit when employee leaves Town service.

JURY DUTY
The town will pay an employee for Jury Duty for any regular scheduled working day. However, if the employee is not scheduled to work, the court system will pay their allotted sum.

BEREVEMENT TIME
Three Days paid to full time employees, or full time elected or appointed officials who suffer a death in the immediate family. The immediate family to be considered as spouse, children, significant other who resided with the employee for six (6) months or more at time of death, parents, parents-in-law, or siblings.

AUTHORIZE SUPERVISOR'S REPORT TO STATE COMPTROLLER

Resolved, that this Town Board authorizes the Supervisor to use the annual Supervisor’s Financial Report to the State Comptroller for the Annual Financial Report to the Town Board to be filed in the Town Clerk’s Office, where it will be available to all interested persons and to publish an abbreviated form of the report for the 2007 year in the Windham Journal.

PLANNING BOARD MEMBER APPOINTMENT

Supervisor, Dixie Baldrey said at the last meeting that the term of Richard Banks expires on 12/31/2006 as a member of the Town of Lexington Planning Board and the Town Board needs to find a replacement. The Town Board received a letter from Richard Banks stating that he wanted to resign as of 12/31/2006, which was accepted by the town.
The Town Board received a letter from Ralph J. Albino, a resident of the Town of Lexington, saying that he would like to become a member of the Planning Board.

A Local Law is being prepared for the next meeting on the tax exemptions, and they hope to have it written up before the next meeting.
Supervisor Dixie Baldrey reported that the fuel bid was worked on and by the time it gets done, the heating season will be over ---- The Town Clerk will prepare the bid specifications so it is ready when your want it.
Need to complete the Emergency Preparedness Plan, and need to change a few names.
Flood Maps --- They were reviewed by Council members Keith Mellott and Lynn Byrne, and were hoping that Council member Paul Van Valkenburgh could look at the West Kill area. Lynn said that she would type up what she and Keith found to respond to. A discussion was held. The Town Board decided to have a meeting on January 25th, 2007, between 6 PM and 8PM at the West Kill / Lexington Community Improvement Association, where the maps can be spread out for the people to view. Going to ask James Boyle to come and bring his flood maps.

SNOWMOBILE CLUB

The Town Board members discussed sponsoring the snowmobile club and they agreed that they would give Glenn Howard a verbal agreement to sponsor the club, but there would be certain restrictions they would like to put into the agreement. Supervisor Dixie Baldrey will contact Glenn Howard with the Town Board’s verbal agreement.

With no further business, on a motion from Council Member Maurice Nelson, seconded by Councilmember Keith Mellott, the meeting shall be adjourned. Carried unanimously.
